Irrelevant. You said the Supreme Court doesn't make partisan judgements, when it self-evidently does (Scalia's ruling on the wording of the Second Amendment would be another off the top of my head). In fact gerrymandering is pretty much the only way the Repubs have a long term future (without a fundamental reinvention of themselves) because the demographics keep getting worse for them'; if the election was a straight winner takes all vote the Repubs would never get in again.
