I wasn't blaming her mother btw, I was just pointing out that she'll be legally accountable for the fine(s) and whatnot. It's also the parents responsibility to instill the details of the law in their child and to supervise them, which is no doubt something the RIAA will use against them should it continue further.

Personally, I think it's all fucking insane and the RIAA are capitalist pigdogs.

Yes a 20 year old, a legal adult, they can vote, have sex, smoke, drive etc etc.

And as such are expected to have a much better idea over a 12 year old with whats right.

And before you say it... people deemed to be insane who murdered someone because of it, arn't sent to jail as it's seen as Dimished Responsiblity (sp?).

These laws are their to protect people who really don't have any better idea about what they are doing from being put into the same boat as people who do.

cant be arsed to read all the replies, so if this has been said tough :)

So her parents knew she was downloading from Kazaa, and her parents were also paying for her to do it, her parents also should have known it was illegal.

I agree that its out of order to do this to a kid, but her parents are responsible for her actions so they are the ones that should be punished, they were even paying for the service so there are no real excuses for them.

Why? Why should they have known that it was illegal?
Not everyone knows about the whole Kazaa/Napster etc. thing.

They paid 30 bucks every months for the service - maybe they thought they were paying royalties for the artists whose music they downloaded.

Jumping to conclusions always helps - but I guess that's human nature.

On a related note, at 12 I was stealing magazines (no, not those type) from newsagents. Thank fuck the RIAA didn't come after me!!!!

Sorry to have to disagree with Uncle Sick as I have been in complete agreement with him so far, however...

For the type of burglary where someone breaks into someone's house, then I think they should get as high a punishment as the law can provide.

I really don't see why that farmer was sent to jail, he was protecting himself and his property, it's not like he went shooting in the town ffs, and then the burglar tries to sue him! He should be locked away and have the lock melted.

However, if it's a burglary of a shop or otherwise uninhabited place then that's less serious, but breaking into someone's house, possibly armed with a knife, gun, with intention to harm and steel... they loose all protection of the law and desearve to be shot if you ask me.

Anyway, getting off topic a bit.

hehe think there's a thread on here somewhere about Martin.

I've read the case notes etc from the court case, and I have to agree that his punishment was apt. Fortunately you dont get the hyped up rubbish from the actual papers used in the House of Lords like you do in the Sun or the Daily Mail. Quite an interesting read.

How so? If you launch Kazaa it doesn't say: "Yo! Watch out, you are doing something bad! If you want to proceed to do something bad, click "ok"".

You just type in the name of the piece or the artist and off it goes... but 12 year olds are supposed to know that's bad. Right?

When I dled Napster I didn't know it was illegal. In Germany you can make a copy of a movie or cd and pass it on to up to six friends/relatives. You can tape music on the radio and make another six copies etc.

So how the fuck should I have know that it was illegal? It was perfectly fine according to our laws here - then the Napster craze started.

And throwing a brick at someone... ? Stop comparing apples with pears.

Edit: AniDante - I was just quickly looking for an example. ;)

I think every man and his dog know about the RIAA and their quest, if they don't then they need to come out from under the stone (I am talking about the parents here not the child). I also think it is pretty common knowlege that Kazaa edonkey and any other p2p network is being targeted by MPAA and RIAA, surely that should give a clue as to how legal it is.

Hell even my grandad knows about the RIAA and their quest, he doesnt even own a computer.

I can't believe how others here think a 12 year old girl and her mom would know it was illegal, it has no warnings, and generally you don't pay money to do something illegal!

They should sue Kazaa for goodness sake.
