Tapeing songs from radio is also illegal.

Oh and i am glad you both find it hilarious that a 12 year old girl and her family are being sued for such extreme sums. Hope you two get a good shock at some point in your little lifes.

Actually its not illegal as long as u get rid of the recording before its six months old, and with Video tapes its 11months.

I'm sure there are plenty more people who deserve to be 'caught', and a lot older to deal with it. I think this is disgusting, and there's no way in hell she should be sued, regardless of what she did - she would not be on trial if it was murder, so why should she be 'on trial' for this?

I'm sorry, but I hardly find your comment about '12 year old girl = owned.' very funny. She does NOT deserve the treatment, as she is only 12.

Poor girl. What you guys have to understand is that not everybody understands the internet for gods sake. I have no idea waht this service charge is that they're on about but i do think that they thought they'd paid for it.

Conclusive proof that America has no sense. 12 years old :/

(on that note. i have star wars episodes 4,5,6 all on tape from when the BBC was showing them on TV during christmas around 1992. does this mean i can be sued??)

The family signed up for the Kazaa music-swapping service three months ago, and paid a $29.99 service charge.
I don't use Kazaa, but I thought it was free software you downloaded and ran to act as a downloader/server and everyone else did to share files, P2P. Since when do they act as a company and charge a service fee to download files? This makes it seem legal, and the american music whatever company should be suing Kazaa, not the poor people they've taken in with it like this.

Also, how the hell CAN they sue a minor? Surely not even America is that screwed up to take a 12 year old girl to court?! Mind you with the number of lawyers in that country...

Thats hardly the thing at hand. Im sure tRoG has done lots of ilegal things on his pc, but at least in my case I would have to take responcibility for my actions. Although in this case its oviously way over the top. Even $3,000 is too much. Uless ofc this 12 year old has been making a LOT of money by selling the songs on or something...

And, I have no objection to that, because I know what I'm doing is wrong.

first of all she "paid for a kazaa subscription"
and she thought that she wasnt doing anything illegal!

so in a way its her own fault. then again, who else is it?
im not saying that this is right. completly opisite.
for example.
you download a piece of software costing £1000.
now the software companies, to make them either get more money or to make it more exciting, say that they have lost (n number of copies downloaded)*1000 worth of profit.
but they never take into account the fact that probably 99% of those who downloaded would never buy it in the first place, they only downloaded it because they could, and if it was not an option, used something else.
i am totally against the riaa, i think that if it is possible to do something in terms with computers, you should be allowed and its teh developers/publishers fault for making it possible.

i think its right she should be sued. she cant just claim "i didnt know it was illegal", if so then why cant an adult claim that? its like a 14yr old can claim they didnt know something was illegal then a 16 year old cant because they are classed as an adult. why would a 16 yr old know more about law than a 14 yr old... ;)

well how does it make sense that at 12 your not expected to know anything, then at 16 you should know everything? what if a 30 yr old just go their first pc, knew nothing about the 'net or its laws, he would still be fined, even though he knew nothing. the legal system is already fucked imo
