Christmas Bank Holidays

Ok this year both Xmas day and Boxing day fall on a weekend so where i work we don't have to work the Monday but they are saying Tuesday is a normal working day.

I went onto gov.co.uk and the 27/28th are classed as Bank Holidays because of them falling on a weekend.

So is Tuesday just a normal day or what?

It's a bank holiday. Depends on how your job treats bank holidays though.

Well xmas day is not classed as a bank holiday, only boxing day is afaik. So your work seem to be correct.

How can they treat a bank holiday any other way though?

My bad, a quick browse seems to confirm they are both bank holidays.

Your work may treat saturday as a working day, so not give a substitute?

You don't have an automatic right to paid leave on bank and public holidays, though many people receive the day off work. Any right to time off or extra pay for working on a bank holiday depends on the terms of your contract of employment.

I went to gov.co.uk today and thats why i'm asking about the whole situation, i'll just go in tomorrow with a print out and ask why do i have to work it.


No doubt i'll get fed a load of shit and end up having to work it anyway so is it worth the hassle?

Depending on your terms and conditions of employment they may only give bank holidays as days off if booked in advance, and include them as extra days in your standard holiday allowance. That would seem to be their only reasoning.

We're off Monday and Tuesday as well, depends how many bank holidays they've already let staff have off though, I don't think they have to give you every one and can let you take them later/earlier if you want as part of your annual leave. We do that with some of them.

I haven't decided exactly yet, but I'll probably close our place on the 23rd and reopen again on the 3rd, giving 12 straight days off.

The bank holidays for Xmas and Boxing days carry forward to the first available weekday.
Xmas Day on Saturday - bank holiday carries over to Monday.
Boxing Day on Sunday - Monday is already a bank holiday, so carries over to the Tuesday.

My lieu days fall on that Monday and Tuesday so work have moved them earlier to Thur 23 and Fri 24. So I get 5 days off over Xmas weekend before being back on the clock on Tuesday.

And people still try and take you to tribunal, you good boss you :D.

In the NHS we get all bank holidays off, and if we do work any of them we get time off in lieu as well as the payment. Got all of Christmas off this year, but do have to work on call New Years Eve for no extra money, unless I get called in that is.

I know!

It's actually the only time off I get now. From March until November I'm on 24hour call, and can't even leave the county. So we get the holiday in when we can. It's good to have a good long break at that time. My first job was in retail and you had the choice of either Boxing day or New Years day off, but not both. That was a bitch.

ive been told if i want to take time off in december for a holiday i'd already booked, i'll lose my job.

i'm paid £6.75 as a chef in a patisserie that isn't even open christmas/boxing day.

That sounds about right mate - most employers require you to book your holiday with them before actually booking it. A lot of places that are traditionally busier over the xmas period do not allow employees to take time off during that period.

Your best bet is to hand in your notice in time for you to leave for your holiday and then find a new job. Better than being sacked.

I'd cleared the time off with my boss before booking the holiday, and then my formal holiday request was denied.

Sucks.

Well you could argue that you had a verbal agreement in place. Is it a one shop place or a chain with a proper HR department?
