He got the misconduct charge for doing it after being sent off, which you aren't allowed to do. Had he shouted at him during the game, which incidentally he did and does every game, there is generally no problem. Also captains are allowed to talk to the referee, it's the rest who aren't suppose to.
If any of those other players did actually break the rules like Rafael, then they should be charged too. Using that shit picture to try and protest his innocence is bullshit.

That isn't really misconduct because hundreds of players do it every weekend, doing it after being sent off is what makes the difference.

You specifically commented on the two occasions I pointed out. No one has done what Gerrard done, I doubt many others than top England players would have gotten away with it either. You see Rooney, Terry and Gerrard walk around like they are above the law, why? Well because most weeks they can get away with far more than most.
The rules are there, they are just being applied at whim by weak referees.
