I don't know the explicit details, however Microsoft used to scan for pirated copies on their auto-update (and mentioned in their ToS), however it was still tried in (Danish only?) court and sentenced illegal, forcing them to stop it.
Considering that you only have to check the cd-keys to find out wether it's a pirated copy or not, I'd say a memory check is alot more intrusive.
