I think they proved that saying a swear word relives stress etc when you're under pressure on a critical task.

Anyways, what's the point in apologising if he keeps you on a written warning...

You do know that unless it's gross misconduct (which swearing definitely isn't) you have to have 2 recorded verbal warnings before they can give you a written one?

I would check our office manual, but it's over 1000 pages long for a company that employs less than 200 people.

According to my letter - "It has been decided to issue you with a FIRST FORMAL ACTION. <their caps, not mine>

The FIRST FORMAL ACTION will remain on your personnel file for a period of 6 months from <date> after which time it will be disregarded for disciplinary purposes"

As far as I'm aware, that's a written warning, not a verbal.

That last line is bold & underlined. And being a solicitors, I'm not even gonna try and fight it, just get out as soon as I'm able.

TBH, lawyers are generally the worst offenders for legal compliance, but you probably are best to get out ASAP!

change the admin passwords on the domain, delete the "clients" folder and break the scsi card into the motherboard of the backup server, prior to this arrange ALL offsite backup tapes to be delivered to you and lose them.

fkin bunch of ***** solicitors are, i worked for a set of ***** like this once, had to get out in the end else i would have BOFH'd the entire place

I think you get arrested for criminal damage for that.

Somewhat amusing he feels a need to enforce the apology given that as soon as you are off company premises you are very likely to repeat the statement and sentiment and if anything have increased animosity towards him and/or the company. Thats poor man management skills right there. If you have a history of mouthing off and attitude then yeh, it would be justified. If a one-off, then its pretty much as I've already said.

However, if you do move on I'd recommend against burning bridges, as hard as that may be. When you have some distance from the incident you can look back with satisfaction and know you retained the high ground. This is one of those things which is purely for your own long term satisfaction that you stayed professional.

It's certainly a one off, first ever disciplinary, first ever apology letter.

DOC - The thought has crossed my mind, but I think there would a lot more charges than just criminal damage. That's a risk I'm not willing to take. Maybe signing him for some gay porn sites...

I totally understand what you're saying Roo, the guys I directly work with have the same thoughts, doesn't help calm me down when I want to throw something sharp and deadly at his mocking face though...

The rest of the day was uneventful after mailing up the letter, so hopefully the matter will be just laid to rest now, allowing me the time to seek other work.

If you are planning to get out anyway, then spend the time leafing through the handbook. The section on disciplinary action should at least be clearly marked. If they have jumped the gun asking you to write this letter and issuing a written warning then fight your corner.

Is it worth the effort though? If he plans on leaving, then its not going to benefit him. Yes I know there are other people he works with and 'maybe' HR or other groups might use a little more caution next time... but something that can be easily forgotten I'd say isn't worth stretching out over months and winding yourself up further.

I've been close to a few things like this in the past, say sorry... move on.

Think this is something you should take up with your union really...
Does not sound fair with such a big slap for what you say you did.

Hope everything works out else seeking new opportunity sounds like a fair thing.

i agree with this one.

i'd talk with my union before doing anything (and also make sure my boss knows i'm talking to the union).

Just use any random apology letter sent by GoA for creating mayhem throughout the EU servers. They are rather balanced and mildly generic but with a touch of ass-kissing. Good ingredients for an apology letter all together i think :D

Haha just make sure you send him an English one, not a German one like some english guy recieved.
