They sent me a recorded letter about 2 weeks ago but we weren't in. Samm rang the Post Office to see who it was and it was them so I just didn't collect it.

I know I won't get away with this but I have until the 16th of December to try and avoid a court date. If I get a letter the next step is to ask for the calibration certificate to waste a bit more time.

16th december is 6 months from the speeding date, I am right in thinking they have up to 6 months to prosecute aren't I? After that they can't have me can they?

6 months to lay papers for prosecution IIRC, not 6 months from the date of the offence.

here's a question. i overtook two vehicles in a row today in a 60 zone, road's a little narrow but i know it very well and both were only doing about 40.

the road is straight so i could see any traffic coming from a good half a mile away and i overtook them just after a bridge, on the other side was a patrol car - which i didn't notice 'til i was parallel with it.

did i break the law? i'm guessing they'd have whacked the sirens on and pulled me over if they wanted to. i wasn't speeding, perhaps driving a little recklessly but i'm confident that i know the road well enough.

so am i gonna get fucked? i don't fancy the police turning up on my doorstep.

I think you will be fine tbh. People driving that slow on a 60 road are the reasons there is so many accidents with people trying to overtake stuff.

Overtaking is a legitimate manouvre if done safely and correctly. Unless you were ragging it up the queue with yards to spare to oncoming traffic and doing 30 over the limit they wont do you. Reckless driving is what theyd get you for I suppose - possibly speeding if they had the kit in their car to measure?

If it was a patrol car, and no camera (window would be down, or an officer would be stood outside the car), and they didn't follow you, forget it.

Provided there were no junctions on the stretch you overtook, and provided you didn't break the speed limit, and provided there wasn't a solid white line on your side, or a pedestrian crossing, you didn't break the law

TBH, people driving unsafely, and unlucky incidents are the cause of accidents with people trying to overtake stuff. A bit of blame can probably be placed on both people in most accidents.

Slow drivers can piss you off, but being pissed off can lead to accidents. You can't go into court saying, "He was going 40 in a 60, I went to overtake, hit a plane on a small puddle, and spun out of control into the side of the other blokes car. It's his fault for making me overtake", even if it is true that you wouldn't have planed on said puddle on the other side of the road if you wouldn't have had to make the decision to overtake.

the road in question is bumpy as fuck and full of potholes, so 40 isn't that unreasonable. i know where all the nasty potholes are and where it's unsafe to overtake though.

I agree with Tom. Alot of the NSL roads near me, out in the middle of nowhere are basically "Couldn't be arsed to come and look at the road to see what speed was safe. But we looked on the map, and there's no houses."

dont know if its been said already, but the speed limit on a road is just that - a limit, not a target or a guideline.

Its the maximum speed (by law) that is allowed. You CAN do more but if you are caught then you are penalised.

I wouldnt mind at all really if it was people like Tom (by this I mean has done all the extra advanced stuff he has) but its not its anyone that gets caught regardless of if they are a good driver or not getting off with it.

Regardless of whether there are speed limits, conditions or time of day or bla bla bla; what I don't quite fathom is why are people in such a rush to get somewhere? What exactly is the point in speeding? Seems like a worthless risk with no benefits.
