I have just received a letter saying that I was caught doing 107mph on a motorway in Scotland.

I don't know how it works up there, can they come after me seeing as I am in England? Am I likely to get banned?

It was a clear sunny day and the motorway was really quiet, it was one of those fucking mobile safety vans sat on a bridge that got me.

If I lose my licence I will lose my job and basically be in deep shit.

Any advice appreciated luvs.

Its not as if you were in Peru ya plonker, its UK law, so it makes no diff that you were caught in scotland or england. I doubt you'd get a ban though for the first offence.

Scotland does have different laws though.

I read on the site that pcg79 linked me to that if my bird fills the form in and I return it unsigned it may get me off.

Gonna read some more on it when im not so pissed.

From what I've heard, Scotland are pretty harsh on speeding offences. A friend of mine was clocked doing 106mph and got a three month ban and a fine to go with it.

Sign up with them if you think it's going to be a problem, they got some guy off doing 175mph on the M25, so they should be able to help. It's only £5 a month, and seeing as you were done by a camera, they should be able to help.

Really sorry to hear this Trem :( There but for the grace of god and all that shit...

Pepipoo have had some notable successes, but all they do is help the government close up the loop holes in the law.

Some of their advice is also a crock of shite and following it could well end up with a longer ban and worse fine.

Any speeding over 100mph is almost certainly a ban, but courts will take into account extreme hardship in terms of job loss etc. Be aware of course that everyone tries this on so you'll have to have pretty watertight proof.

If it was a van type camera then it will probably have a photo of your face, and so the 'Samm did it' line is unlikely to work, it'll just make the magistrate grumpier.

I have no doubt that you'll get all sorts of advice here saying that all you have to do is fight and you'll get off. I don't think this is true, it's a possibility but unlikely. The most sensible course of action would be to throw yourself on teh mercy of the court, be really really sorry, plead extreme hardship and see what happens.

If you do decide to fight it then I wish you all teh luck in the world and I hope it works.

For a far more balanced view than pepipoo look here. They have cops, magistrates and a very vocal pepipoo representative, look through old speeding threads and start one of your own if you feel the need. They are a non judgmental lot as long as you don't start with 'I just got done for something really stupid How do I get off?'

You need to go to court. Get a lawyer and don't try to dick around with the system. NB. You have a right to see the evidence before you go to court.

I was caught doing 117 on the M180 and I got off with a 28 day ban, no points and 100 quid court costs; I just turned up in a nice suit (when every other crim in the Magistrates court was in traccy bottoms and fake burberry) and did my pillar of the community bit. Of course you could get a magistrate who's an arsehole, but when you look at the dregs who go through the system the odds are in your favour if you play the game.

Well Pepipoo are telling me to return the form completed but unsigned, in my opinion this will piss the police off more as they obviously know about this advise.

If someone says to me I will get 6 points a nd a fine I will go by the book but I'm worried if I return the form they will ban me.

I will lose my job if I'm banned, so obviously I am really quite worried.

Mate, from what I understand of the law they need to get the NIP to you within 14 days of the offence, I see from your pepipoo thread it took them 28 days for it to get to you. Surely that means it doesn't count?

Thought you were onto something there, but I think that the fact that it was a hire car would make the difference. As long as they have got in touch with the hire company within the 14 days then you're still screwed.

In addition if Samm wasn't added to the hire agreement I certainly wouldn't try the 'it was her driving' as she'll be done with driving with no insurance, much worse.

If you were banned Trem it wouldn't be for long, 28 days at a rough guess, but if you can prove that you'd lose job/be unable to pay mortgage then this would probably make a difference.

If they don't ban then they would up the fine considerably though.

Good point Bods but like RB says they may of contacted the hire place within 14 days, but I guess I will never know.

Might be worth phoning them up to find out. I'd still sign up with that Freeman Keep Driving, they will be able to help. I had advice off them within 3-4 days of signing up.

From what I hear (my uncles a magistrate) I'd be inclined to agree with RB about the extreme hardship thing, if you can prove beyond doubt that you'd lose your job if you are banned then it should help. Admittedly I've only had a very limited experience with this sort of thing though (I'm not driving yet), so I dont know enough to offer any learned advice :(

Thanks guys, really appreciate the help and support. Although lets face it I maybe, only slightly deserve to get banned.

Yes cars nowadays can handle way above the speed limit, but you know, ho hum.

Typical. Trem drives at warp speed on a peaceful empty motorway and risks a ban.

Scrote drives a nicked car with no insurance/MOT/tax, after 3 spliffs, and wouldn't even receive an NioP.

Wanker scamera pratnerships. TBH Trem if that was a copper in a Volvo, and you'd seen him quickly, slowed down, and licked his boots, you probably would have got away with a warning.



BTW, can't you just take the S172 and the fine + 3 points? No ban if you go that way (unless you're on 9 or over now).

Its an option tommeh but they could still have me for speeding it seems. I dunno whether to just bite the bullet.

I am trying to not lose my rag over this but it truly takes the fucking piss, I am trying to tell myself it is my own fault.

i love speeding.

i doubly lovre the fact i've managed to fly past police cars at 100mph without realising until they're in my rear mirror and nothing happening. at all. perhaps they're shocked to see a womans car in the outside lane 8)

i hope you get away with it trem. speed cameras on motorways are fucking pointless, the 40mph limit on the m4 takes the piss frankly. it defeats the point entirely, does it not?

I hope whatever you get that it's the least possible; I'd go with the "don't piss people off and play by the rules" approach.

You need to think how you will manage this at work. Do you get paid if you are sick ! If you do then this is route I would take. Go to your doctor and start complaining about lower back pain and that it hurts most whilst driving. Any luck you will get a sick line for a few weeks and a few appointments at a physio. Obviously time it to coincide with your bann, because the chances are that you coud get one, particularly since you already have points.

No offence mate but people who fake sickies p1ss me right off.

Trem, if it comes to a ban, pleading will likely get it right down, you may be able to combine your holiday allowance with the ban, and you may also consider getting friends/family to chauffeur you around.

I am calmer about it now. I am leaving it until the last minute to return the NiP(unsigned). That way I have completed my obligation and it also throws a spanner in their works when taking me to court, although that will still happen.

I definately don't want to get a lift to Scotland and back for court but I will if need be, at least it was just after Glasgow(iirc) which isn't such a bad trip.

Its a bit crap that I can't be arsed looking for a new car at the minute because of this, I mean whats the point, I could get banned for 6 months(unlikely but meh).

I am hoping that it will time out(they can't do anything after 6 months), but if they offer me 6 points and a fine I will take it in a blink of an eye.

I won't do the sicky/holiday route, I am too honest for that and I would fuck it up. I will deal with whatever happens at the time.

It will be dead easy to string it out over 6 months matey, I'm just getting taken to court now for an offence that was 4 months ago, and I returned the NiP fairly quickly signed, whereas the other one I have pending was 3 months ago, I haven't returned a thing yet and I have heard nothing at all yet, they're pretty slow.
