Ok so my wife and I have decided to go our different ways and get divorced.

Question is whats really involved?

We dont have kids but do have a house and a mortgage.

No 1 has cheated we just arnt happy grown apart and neither of us want to be in the relationship. So no nastys there.

Ok, I got divorced in 2000 but my circumstances are slightly different to you as I have children to factor in the proceedings.

Firstly, you will apply for a decree nisi which can be obtained quite quickly. Next you will review your financial positions including if you should pay any form of maintenance to your "wife" (I told her solicitor to fuckoff, I would pay for my kids but not the upkeep of my wife).

Once that is finalised and everyone is in agreement you get your decree absolute. Bottom line, it can take under 2 months to get your divorce. If you fight over money that's where it will take time.

Assume the following, 50% split on everything you have achieved since you lived together for more than 6 months (marriage is irrelevant here).

Bel I am not divorced but I have been separated for ehum nearly 10 years. If there are no complications with financials etc then you can do it for the cost of the court fees online.. when I move back to the UK this is the method I will use. I would do it whilst I was in NL but I need to be resident to do it the online way.

If it is amicable why not wait the 5 years, I think it becomes cheaper if you want to engage a solicitor and you dont even have to know where your ex other half lives.

I thought it was 2 years from being apart and you then can apply for a divorce and if not contested it is automatic.

I think that is correct, however at 5 they dont even need to inform the other party (iirc) if they are unable to locate them.

This is correct. Unless you really disagree about money, try to avoid lawyers if at all possible (well, duh). My ex and I did that and the whole thing only cost a few hundred quid.

If neither of you wants to blame the other for the marriage break up, you'll have to wait two years to get divorced with consent. This is what I was supposed to be doing until my ex decided he wanted £2,500. I'm now having to wait five years so I can divorce him without consent.

The cost of submitting a divorce petition in the UK is £300 (I believe that's standard) plus there's another charge of around £40 when you apply for the Decree Absolute (six weeks and one day after the Decree Nisi has been awarded).

Usually, if it's an amicable split, you just decide to divide up everything and then you'd either sell the house and split any profits remaining after the costs have been paid, or one of you would buy out the other.

Anyways, the government's website is very helpful so I'd say have a look at that and it might help with a few of the questions.

If neither party is wishing to blame the other, ie there is no cause for divorce, (adultery, assault, abuse etc), then you have to wait two years with consent. Feel free to go take a look at the Government website here or the family advice website here.

Yes, you must be able to prove to the court that you have reasons (or “grounds”) for saying the marriage is at an end. The expression the court will use is that the marriage has “irretrievably broken down”.
The court will accept one or more of the following “facts” as proof:
• that your husband or wife has committed adultery and that you find it intolerable to live with him or her;
• that your husband’s or wife’s behaviour has been so bad that you can no longer bear to live with them;
• that your husband or wife deserted you at least two years ago;
• that you and your husband or wife have lived apart for at least two years and he or she agrees to a divorce; or
• that you and your husband or wife have lived apart for at least five years.

The Decree Absolute takes six weeks plus one day from the date the Decree Nisi is issued - which is what I said.
