perhaps because thats altering and Mythic dont ban for Emote spam so why would Mythic need to change something that GoA clearly has a different opinion about?

Probably because GOA receive the shit from Mythic, and either GOA or Mythic can't be bothered with coming up with the oh-so-obvious solution.

I have a large collection of Screenshots from emote spam (from mids and hibs) never bother to send any in though I must admit the thought went through my mind to wait till I know the cluster release date then 1 or 2 days before that send those screenshots in of the people I dislike and get them banned right when cluster happends that'd sure piss them off

1 emote is normally enough to have someone stand over you after adding or running in a full group with SO and SO is laughing at you 30 odd times is damn anoying especially when your trying to release.

there is no reason to spam emotes at someone especially after they have died. Ok it might be lame to report them to goa for spamming but in the end the person that is spamming is technically greifing the other person.

if you had someoen sending you spam constantly through sends or through a broadcast channel wouldnt you report them for anoying you and ruining your game ?

The emote spammer is more lame and pathetic. Such a childish thing to do, just as /bind spamming was. Does mythic have to implement restrictions to all things which simple common sence would hinder you from doing?

Reuse timer on /bind
Reuse timer on /s
Reuse timer on /em
Reuse timer on /gu
Reuse timer on speaking to NPCs
Reuse timer on combat mode
Reuse timer on realm abilities when they "fail"
Reuse timer on instant heal
Etc.
