If deterrence is such a powerful weapon in your books, then how do you explain the difference in the crimerates of - say - the United States (death penatly and pretty tough conditions in jail) and NL, GER or SWE (no death penatly and "soft" jail)? And you can scroll back through the history of crime and culture and find, that even in the middle ages with sharp eye for an eye justice system, people were not safe from all kinds of crime.
Your formula: threat of punishment creates fear with decreases crimerate is too simple in my opinion.
