Paid too much wages

last week i worked 2 shifts and should of been paid £70. i checked my back account and ive been paid £120.

my question is am i obliged to give it back or is tough tittys and lots of free booze for me?

If work realise they made a mistake they are within their rights to deduct the difference from yuor next pay check.

the problem is i was working with an agency now ive got a permnanet job and they said they took me off their books.
i got an idea it may of been holiday pay for days i didnt take.

More than likely will be, standard procedure for people who have worked more than 3 months on a contract iirc.

How about having a look at your payslip....
which they are legally obliged to provide you with. You should also have received a P45 from them if you have left their employment.

I've done agency work a bit in the past - it's holiday pay you haven't taken - you tend to accrue a day's leave for every week or so worked depending on the agency. If you don't take it they give it to you when they leave.

On a related note, I'm leaving my current job soon (and there was much rejoicing....yaaaaay), but the people in my office seem to think they'll try and take money off me cos I've used up all my annual leave for this year and I'm not going to finish the year out. This sounds like bollocks to me as I didn't know I was leaving when I took the leave, and surely it's up to me when I take the leave. I was quite happy to go to April without any more leave (sickies rock tbh). I know leave is worked out pro-rata but surely that's only if you join halfway through the financial year? Anyone know anything bout this.

You're usually given a leave allocation, which is pro-rata, but with most companies you actually accrue it based on the number of months you've worked. So you're yearly entitlement might be 24 days for example, but if you take them all in January, and then leave at the end of June when you've only actually accrued 12 days, they would deduct the remaining 12 from any outstanding wages you are owed.

This happened to me when i worked for Carphone warehouse as a student. Was working part time but recieving full time wages. I just stuck the extra money into a high intrest account. By the time they cottoned on I gave them back the overpay minus the intrest. :)

for the first time theyve sent me a pay slip and it was holiday pay. also receieved the P45. was i supposed to give that to my new employer before i started? because ive already done 2 shifts

Happened to me about 10 years ago with the same circumstances yourself, I used the same arguement and it took me 3 months of phonecalls and letters to get the money back. I was only 3 days money but it was the principal, I had no intention of leaving when I took the holidays 4 months before I had left. Sadly companies regulary pull that stunt, then they moan when people take sick days to do stuff rather book holidays.

Well our work rules are clear that you earn holiday based on a years work, so if you leave early you owe the holiday you haven't earned.

They will probably take it out of your final pay Bodhi, and there isn't mcuh you can do about it.

As far as i'm aware if you get overpaid and don't own up you can technically get done for theft. Just someit to consider if ya thinking of not telling.

Yeah, your holidays have fuked your pay.

You could be completely unscrupulous and shaft your current company: ask to extend your official leaving date by (*however much you need to cover the paid holidays*). But then phone in sick for that last stint whilst you jaunt off to your new job.

Doesn't look good though if you get caught (through NI). :)

The second month in my new job I got paid £11,000, about £8.5K too much. Didn't mention it, never got questioned, end of. That was three years ago now....

hehe same here, think work fucked my wage up abit too, they payed me on avrage £14.50/hour instead of £11. got £120 for 8 hours work xD
