Ok heres the deal..

I auctioned my mates PS2 the other day and specifically said I only post within the UK.

Anyway this French bloke ended the auction early using buy it now, he then sent me the money without waiting for correspondance and there wasn't nearly enough to cover shipping to France. I said in the listing that I only accept paypal if using a bank account to avoid cahrges but he used a credit card and I got an 11 dollar charge :/

anyways I want to refund the money and relist the item as I am technically within my rights to do so (i said UK only).

The problem is I dont want negative feedback, which the spiteful bugger has already done on a few occassions to other people. I would also like to relist the item for free as it cost me 7.50 to list it the first time. Either that or a refund.


What should I do?

Why not just get him to pay the rest and ship it to him, far less hassle than relisting

Shipping will probably be 40 quid which I doubt he'll pay. He also doesn't speak english and won't reply to my emails.

If you get negative feedback you get an opportunity to respond to it.

Most people (I would imagine) wishing to place a bid will check out any -ve feedback first. If there is a sensible reply to the -ve then I for one would still bid.

you should be able to get your 7.50 listing fee refunded if you said in the auction UK only ! (well, the final value fee refunded, and a chance to list the auction again for free)

to be honest, if you contact ebay Customer Support, they'll probably cancel the whole auction and neither would be able to give feedback either! (have had this happen before !)

Yeah, it's a pain in the arse when these bloody foreigners don't read the T&Cs of the auction properly.

I have now started to put "THIS IS A UK AUCTION ONLY" in large letter on my description rather than the eBay small print.


Still got a bloke from Aussie and one from Canada bidding though. :rolleyes:

Probably a bit late to help, but...

If you stated in the original auction that you only shipped to the UK, and that Paypal was only accepted with an account, and he closed it with BIN, then he is expressly agreeing to the terms of the auction.

Email him, explaining the situation. Point out:
a) the original auction specified UK only
b) the original auction specified Paypal would only be accepted with a bank account

Therefore his bid cannot be accepted. Refund him the cash. You might also like to expressly ask him "is this ok with you?" (regardless of whether it is or not), and point out that you won't be leaving him negative feedback. Also point him to the section of Ebay where it says you shouldn't use feedback as a blackmail tool etc. If he leaves you it, just report him to Ebay. At the end of the day, HE breached the terms of the auction, so it's his problem.

w/r to relisting for free, I don't think you'll be able to do that - you could always email Ebay pointing out that the person who closed it couldn't honour his bid, and see what their response is - afaik they'll just go "unlucky".

Now I'm up shit creek with e-bay :( I sold my mum's stylophone on ebay, and it was working before I sent it out (sounds like R2D2 being tortured, but I gather thats the charm). But now this guys got it, he's saying it doesn't work at all. But it worked most definately before, and I sent it the expensive insured route, so it shouldn't have been dropped or anything. Do I have to offer him a refund or what? All he's saying in his e-mails is "It's not working"... "I've put a battery in, and its still not working" "Twiddled the tuner, not working". I don't want to mention the refund word until I have to (because I'm currently wearing the money as a new skirt).

I'm timid, and mildly annoyed.

Get him to send it you back and you'll check it? Say if it is b0rked then you'll replace it (unless its a rare antique moog stylophone ;))

I know, but I'm over the deep end of my three grand overdraft, and I can't get my student loan until I pay my parking fines, and I cant pay my parking fines until I get my student loan, and the last thing in the world I need is to fork out the £6 post and packaging for a working stylophone, and then if somehow the gremlins have killed it, to find the rest of the money to refund it all.

I've e-mailed support, but in the mean time I've chosen the rather dangerous route of trouble shooting/insulting his intelligence.

If it worked when you sent it, then morally you can feel safe in simply saying "it worked when I had it" and leaving it at that. It's not like you knowingly conned him.

If he is happy to send it back to you at cost to himself, using the same insured process as before - and it does turn out to be broken - then presumably you have a claim against the courier/Post Office for an insurance payout.

Get him to send it back and let him pay for postage. Check it. If it's working then send it back at his expense. If not, refund him his money and claim the full value of the item from our amazing postal service.

Get it fixed cheaply and resell it :)

you make even more money :D

fear my car boot sale prowess - bought it for a quid, 10 mins to fix, and sold it for a tenner !
