As you may now, I recently bought a Fiat. It has mostly been all good apart from a random starting issue (which is looking like a problem with the immobiliser), but last week I heard a horrible rattling noise coming from under the bonnet whenever I depressed the clutch. Sounds like a release bearing issue I thought, which is covered under the Mechanical Breakdown Insurance I got with the car. So I booked it into a garage near work who agreed to inspect the car then contact the warranty company, and they agreed it was probably a mechanical breakdown and all was fine. Day before I was planning on taking it in the noise got really bad, and I couldn't select any gears. I didn't have a hope of getting it into Newcastle to Arnold Clark (always had great service from them up North), so I phoned em to apologise and booked into a local garage in Stone as that was as far as I could get it recovered. I made the same arrangements with this garage, check out to see if it's covered under the MBI, if not ring me. No problem they said, so I get the AA to tow me there and the car is left til its appointment and I've been on the bus.

Fast forward to today, the day the car went in. I rang the garage at lunchtime to check on my poor wounded Punto's progress. I spoke to the secretary, who informed me they were just waiting on a part from Fiat and they'd let me know when it was ready. Fast forward to 5:15, I get a call from the garage. I can't take it as I'm on the phone at work, so I call them back straight after. I say "So I assume there were no problems with the warranty company then?" only to be replied with "What warranty company?"

I BEG YOUR FUCKING PARDON??????

Now the entire reason I wanted them to check first, was becuase if the warranty company didn't cover it, I was going to leave it til after my court date next week - no point paying to fix a car I can't drive. However the garage have steamed in and started the job without getting clearance first, so if it isn't covered I'll be faced with a £300+ bill (the garage still haven't given me a quote on the work, just said it will be well above £300). They have also tried to fob me off by saying it's taken so long as its a "9 year old car, things take longer to take off and put on a 9 year old car than one that's a few years old".

Now what are my rights here? I never gave them the authorisation to start any chargeable work, in fact told them not to until they had informed me.
They seem to have come up with an absolute horsehit story as to why it's taken more than a day to fix and are about to present me with a bill I have no intention of paying and indeed, no ability to pay. That's kinda why I got the MBI.

The garage have undertaken work on your car without authorisation. You are not liable for the cost of the work.

Proving that is another matter. If they refuse to return your car, and if you can't sneak it out with the spare keys, you're going to have to pay up and deal with it later. Otherwise they'll stick on a storage charge too.

The car doesn't actually belong to me - it's on finance, so it belongs to the finance company. Is it worth calling them to see what they say?

If this was in Sweden it would be clear and cut - you wouldnt have to pay anything since you didnt authorize the work. The car was there for a checkup with explicit instructions to call you up when the error was located. Anything else would fall under the realm of negative contractual binding principles which arent allowed in swedish law. The car repair shop would have burden of proof that you told them to go ahead with any work done. Not sure about UK law though.

Got it fixed, car runs an absolute treat now. It was covered by the insurance, apart from £90 worth of labour. This was becuase the warranty company have a set time for the jobs to be done in, and the garage exceeded this, presumably because "the car was 9 years old". I smell a rat personally, but at least I know which Stone garage not to use again. Think I'll give you a shout for that dude's number next time tremlar hunnykins. Just a shame the AA wouldn't tow it to MD....

Turns out all the effort to get my car up and running again was for naught. I had my licence taken off me for 3 months this morning.

I was nobbled by a garage in Stafford a few years back, they charged me a stupid price to fix my car which promptly died a week later to which the garage refused to accept fault and told me blatant lies about what they did with it. Now I'm guessing that this Stone you're refering to is the one between stoke and stafford. Hmm I see a pattern emerging here, or at least a morale.
The scariest thing is realising that I used to live near Bodhi :eek6:

Sorry to spoil your joeks, but it wasn't a Fiat garage I took it to. I'm a bit more sensible than that.

Anyway I didn't so much run the lights as decide to go through them rather than hauling my anchors on and ending up on the crossing. I just hope in future I don't come across any more level crossings literally just after blind bends with no decent signage.

Then you were travelling so fast you couldn't stop in the distance you could see to be clear ahead, a very basic rule of safe driving that you broke.

That's bollocks mate, if that had been the case I would have understeered off the previous corner. Truth be told I could have stopped in plenty of time, but I was late for work and the barriers were still up when I stormed through. Don't really see the danger to be honest with you. It was a fully barriered crossing which would only have been dangerous to run if I'd gone through the barriers - remember there's a delay to let stuff off the crossing, I just took advantage of that. More floutism than dangerous driving if you ask me.

Anyway I accept the punishment cos it wasn't exactly my smartest move (not exactly my dimmest either), however it grates a tad when I lose my licence for that (an offence with a standard 3 point endorsement) when the guy who went into court before me got 6 points for doing 97 in a 70 WHILST TOWING A TRAILER. I know which of the two I'd call more dangerous....

I endangered no-one. Wouldn't want that to get in the way of some good sanctimony though so please, carry on.

Considering I'm a train driver and I know what it's like to have dickheads like you thinking the world should stop for them I'm pretty sure I'm entitled to my 'sanctimony '.

Why not try looking beyond your boyracer wanna-be nose and grow the fuck up.
