Can people from nordic countries help me please?!

In the english legal system, we have witnesses, and then expert witnesses, such as a doctor who is an expert in his field and can give a viewpoint on what say, a patients chances of recovery are.

Is part of their classification as witnesses, they are granted immunity from suit - ie, they can't be sued (for example by the person they say caused the harm) for things such as defamation, slander.
This does not extend to disciplinary action by the experts professional body, ie, for Doctors, the General medical council.

In your country, is the law the same as this? How does the system work? Do experts have immunity? Can they be disciplined? Can you provide me with links?

Any help appreciated,

Tild

ps, am also interested in french/german system if anybody knows about them.

In sweden you can't sue anyone, or well you can but will most likley be more costly to you even if you end up wining the case as. And jail time is a joke, recently a guy in his 20's did a armed robbery at a bank close to me, he got his sentence now and all he got was 3 months in the can...

But I guess in your case its like for a insurance case like a broken neck (extreme) and the doctor say no that neck aint broken, so you end up with no cash from the insurance?

If thats it, I guess it's pretty much the same as in the UK.

Let me give you an example.

Mr Brown has an accident at work, it is not his fault. His arm and neck are damaged and he has to take 3 months off work.
His employer Green ltd were negligent and their negligence effectivley caused Mr Browns injury.

In the UK it would happen like this:

Mr Brown sues Green ltd to claim back the 3 months wages (minus the sick pay) in addition to the money he spent on medication, care, and then some money for the actual injury.

In court Mr Brown would have an expert who would have done a report on him, saying "yes, mr brown is unlikley to recover fully for atleast a year" and this would be in support of a higher payment.

Green ltd would probably have their expert saying "mr brown has always had problems with his neck and a lot of his current pain is probably the same as what he's been off work with for the last 3 years" so this would be evidence for reducing the amount Mr Brown is paid.

If Green ltd's expert had said "Mr Brown is a lazy good for nothing layabout who has not been to work for the last year" that would be defamation. However because it takes place in court, Mr Brown cannot sue the expert.

In your country, can the expert be sued? :D

Now...don't you have to quote your sources for dissertations.

In Sweden medical professionals can be sued etc etc

In the .SE it would happen like this:

Mr Brown takes it up with the union he is in.

Unless its a high corp. they crack under the weight of the union and pays the man a small sum.

Nothing more happens.

If the case is that hes not in a union which is highly unlikley in a country like sweden, hes shit out of luck.

in norway i think mr. brown would get his money from his insurance company. Green ltd would probably not pay mr. brown annything. im no expert on this but thats what i would imagne would happen. sueing in norway is rather rare. people might demand a compensation from the company/other parts involved, but not sue them.
