If someone would use same map + locations and trying to remake some locations as in the book would that be allowed or would that person need certain rights?

I've been thinking to make Middle Earth realm for Neverwinter Nights. Not in same age as the book but thinking more about in some earlier age. When the world was more wild. Before the great war.

as long as you don't try to sell it you're fine. include a bag fat thankyou to JRRTolkien in your complementary text file and stress that all names and places and chars are copyright the tolkien foundation or whatever.
alternately you could write them a very polite email telling them you're a massive fan and would like to make such a thing for your personal enjoyment and possibly some mates' as well. be polite, brief and to the point and I'm sure you'll get a better answer than any here could give.
