So as you some of you know from my ‘I’m fucked thread’ I recently started a new job as a bartender. I have been trained up (took about 10 hours) had my first shift on my own tonight. A man ordered a glass of wine, I poured it up to the marking point, as it was very faded I went approx 1 mm above it. The customer said ‘I think you've overpoured it' to which i replied 'that's the kind of barman i am' (implying i would rather go over the measure slightly than under it) to which he laughed. The manager whom i had never met, different ones were on duty for my previous shifts was besides me at the bar. 20 mins later she called me into her office, and promptly fired me saying...

'The comment you made to the customer was unprofessional so we are going to have to let you go'

So with buying the uniform as well as the 3 weeks it has put back during which i could have looked for another job, all the others one have been filled been filled by students i have lost approx 10 pounds.

Now i really am fucked!

I tried explaining to her of course, and asked for the reason for dismissal to be written down and mailed to me as no one would believe. Going to lodge a complaint over her head. (and of course shit on her car)

Oh shit dude, well for one I recently went through a period where I thought I was on the brink of getting the sack. Apparently fraternizing with guests at centre parcs whilst in on a day pass is serious offence... but enough about that.

I asked around and found out, although I could be wrong, unless you havn't signed a contract that you are legally required to receive one warning before any dismissal. Therefore, in your situation you have the right to take action under grounds for unfair dismissal.

I'm no lawyer but that's how I understand the situation.

You have the right to complain under 'unfair dismissal'. The reason she gave you was utterly ridiculous. If you would have said that to me I would have laughed and appreciated it. The comment you made cannot be seen as 'un-professional' in any case. Un-professional would be saying to the gentleman 'yeah well don't complain...' as that can be taken wrong by the customer or whatever. You have the right to speak to the man who 'trained' you etc and see if this can get sorted. The grounds of which you have been fired are nothing short of stupid.

I'm pretty sure the bar can have it's licence revoked if it sells measures over or below the exact measurement.

Maybe I'm going to be hated for this but I sense inaccuracies in the original post (if I'm being kind), not just referring to the measure poured.

Regardless, I'm sorry that you had a negative work experience.

contracts dont have to be signed for their terms to be effective.

if youve only worked 3 weeks youre probably in a 'probationary' period. if you read your contract of employment there is probably some statement in there along lines of

within x amount of time of working, we reserve right the terminate your contract of employment on any grounds we beliebe reasonable.
ofc if you didnt read the contract thats your own fault. ive worked enough shit jobs to know this is usually the case.

going to a tribunal is very likely a waste of time here but if youre set on it then you can get a form here http://www.legatio.com/downloads/ETS/ET1.pdf

Within the first 3/6/9 months (dependant on the company) you are on a probationary period, within that period you can be dismissed for absolutely no reason at all.

Sorry to say but you wont get far taking this to a tribunal

Yeah i'm not going to go to a tribunal or anything, im having a meeting with the manager i usually work under and il seen if i can convince him.

That was bitch ass pedantic, and she should be slapped silly for such stupid comments made be herself imo. A warning would have sufficed and you are entitled to such before instant dismissal ><

Ah well, perhaps it's for the best. In time to come you may walk into that place and be miles above her in stature and you can have the pleasure of shoving it right down her throat :)
