A warning would have sufficed and you are entitled to such before instant dismissal ><

not always and especially if something is classed as gross misconduct youre fucked.

Errr, 1mm of wine and a friendly comment is hardly gross misconduct, nor was it insubordination, oh and btw i've been through unfair dismissal so i know the UK law on this subject immaculately :)

She said the proper procedure would have been to offer to poor the glass out again after he said i slightly overpoured it.

I was like 'Bitch who would want their glass repoured if they got slightly more than they payed for!?' Then i falcon punched her in the ovaries and burned down the restaurant.

(the second bit may or may not have happened)

you are not required to be given a notice for dismissal if youre in what is commonly accepted as a probationary period, which will be stated in the contract.

Actually Tris in the employee handbook it states you have to give notice regardless of status as a trainee, mines in the post apparently.

The probationary period is recognised under law, not as 'commonly' as you put it. But there are still common contingents to that probationary period that must be adhered to, and i do believe she didn't adhere to them. Secondly most get the candid observation of employment law during this period ie warnings to show that you are capable of working within the contractual employment mandate. Az wasn't even given that social transition of probation to what would have been a contract that overlapped it's probationary period.

Anyway, we should even begin to argue over this one, she was obviously a wanker and not worth working for, I certainly would have been glad to get rid of an arsehole like her if wasn't even given a chance to show what i could do. Lousy employer expecting more from an employee that she's backtracking in the sense that she thinks she made an error of judgement in employing him in the first place. Sounds like a pseudo swanky nQQb to place to work anyway and to best rid of it if that's common practice on how employees are treated there. Bad management always has holes in it, she's one of example of how a contract even after the probationary period is as good as a sieve with pouring water in it - useless.

The customer himself was pedantic in his own right, if that was me, i wouldn't have even noticed that amount and just took the glass.

personally i dont believe you are correct but there is no use in exchanging bitter dialogues :)

and ye she sounds like a ****, so maybe youre better off not being there.

not that it matters but i dont believe these would be terms of the contract unless you were given this book first before agreeing to work for them.

Yeah i've already got an interview lined up for a bar opposite the one i got fired from, lol lets hope the managers dont know each other! :p

I worked in HR for a few years before moving to IT. So i know how it works as delt with it everyday. And employers dont have to give reasons to sack you when you are on probation

The whole reason you have as long a probation period as possible as an employer is so you can get rid of people without any legal shenanigans.
