Anyone ever made an injury claim against someone ?

Tripped over some roadworks outside my house in the dark last night, can barely walk - pain is pretty bad (off to the docs at 12.00)

Is it worth it ? I think its the gas company who dug up the road and didnt make it safe enough.

I did last year, got whiplash when someone smashed into the back of the car I was driving.
My insurer put me in touch with a solicitor, I wouldn't go near any of these no win no fee ambulance chasers. (My solicitor claimed her expenses back from the other party btw.)

Make sure you keep records of everything, details of your injuries, how it affected your day to day life, what it stopped you doing etc etc.
Also keep reciepts for any prescriptions, travel expenses (to the hospital for example) and for any treatment that you had to pay for yourself. I had to pay for physio and I claimed that back.
Perhaps some photos of where the trip took place.

Just some points that I learnt when going thru my claim.

I think it totally depends on a) if they pre-warned you with a letter or b) if there are big signs with lights on for night time wanring you of the obstruction.

If either of the above have not been done, I would at least enquire about it (upto the point where its likely to cost you something)

Dunno, perhaps someone else is better to advise.

Sure phone em up get xrays done sue there ass Injury lawyers for you:) i would of got air lifted out that dam hole if it was me kick and screaming bit of Hospital insurance bob your uncle;)

Take pictures of the hole and they way it was secured (or not secured) this is vitally important without proof of this you will not get anywhere, take a few pictures from different angles and close ups if possable.

Yup what Yeke said - take pictures, ideally with a timestamp on them and some identifying feature that pinpoints the location. Also take pictures during the day (to show what the trip hazard was) and at the approximate time of your accident (to show how visible the hazard was).

Tempted to do this actually - although replace John Smiths with a Guinness. Depends what the doc says at lunchtime - badly bruised then ill let it pass, broken bones and ill sue their ass.

imho sue there ass regardless :D

follow peoples advice and take some pictures so if (when) you chose to sue them you have evidence.

ps. hope your leg is not broken!

I think injury claims are a load of balls. Injuries happen. Stop looking for someone to blame. If anything, things are safer now than before. Atleast there aren't treeroots to trip over everywhere etc.
Do you want american practices, where schools ban "contact sports" like tag etc, because *GASP* some kid might get a bruise?

well if i had to take time off work because i injured my self due to someone else, id be taking some civil action against them too. maybe for you its ok to live on half your wages for no fault of your own. for many others, they dont want to be skint for something thats not their fault.

Then take fecking disability insurance or something.
Injuries happen. No amount of sue-ing can prevent it. Just accept it's a fact of life. Sure, you may find yourself getting a tad more money when you sue, but on the greater scale it'll only cost you money because those companies getting sued will have to get the money some way (and now added the costs of lawyers etc) from some place, and since it's a government thing, it'll come from taxes, which you pay yourself. You get nothing by sueing, it'll only cost you more. Those useless lawsuits only ruin the finances of the country.
Accidents happen. Get over it.

I'm afraid not, but it seems that you have a warped view about what happens beyond the borders of your own wallet.

And still you think that sueing a local council doesn't come out of our taxes? (plus lawyers fees, which will probably be higher than any award)

you do realise if he sued the max he can get is between 5-10k depending on what actually happend, how long he is going to be out of work etc.

for one thing it may not even get into court, it could be settled out of court.

he may not get anything, in which case he is paying it all him self. do you really believe giving out compo of a grand or two is gonna bump everyones taxes up all over the district?

If he gets £10k, the lawyers get £20k (even if out of court, the council will still get legal advice before deciding whether or not to settle), the local taxpayers pay an extra £30k.

He'll be up, the taxpayers will be down, the lawyers will be laughing.

And of course the sick thing is it'll probably all come out of the road/pavement repair budgets, so they'll keep getting worse, causing more accidents.

It's not just the 5~10 grand for the compensation. It's also the cost of all the lawyers involved, the courttime, the judges, bailiffs, paperwork, etc etc, which wouldn't surprise me if that all added something like 50~100 thousand.
Besides, it's not just him. It's him, you, and everyone that starts to sue cos *amagad I bumped my pinkytoe* and *amagad my kid fell on the playground*.
Also, those that do the sueing are also the ones that cry the loudest when the taxes are raised.

Depends who you're suing. If you're suing the council, then I wouldn't bother as they are directly funded by tax payers. If you're suing a private company who's responsibility it was to reinstate the road surface after undertaking intrusive works, then sue their ass.

They are still paid by the gov'ment

breaking bones and stubbing your toe are two different things.

one allows to carry on as normal.

the other stops you from working, meaning you start losing money. and cant pay rent, or buy food etc.

Depends, if you brake your leg and work in an office it's not going to affect you that much, and if your office dont pay you for a few days off then get a new fucking job.

Yup, then they'll need to charge the government more to cover those sort of costs, and the tax payers pay more. But at least it's not direct then !

Solicitor fees for council ... well in general they have their own full time legal department anyways so wether you sue or not there people sitting in the office doing nothing as seems to be the case half the tiem where i am.

Depending on the level of damage and the affect it has then you got to decide what is the best action.

For example.

Last year my mother was in Macro's. Things were poorly stacked on the top shelf (15foot up) fell down and hit her on the head and wrist.

She is still in a lot of pain and in a splint most the time. She has taken a total of around 2months off work, maybe more now. And it will be even more soon. She recently had an exploratory Op and they said they would leave it and hope it heals. Just had a nother check and it hasnt, they want her in for another exploratory Op to see if they can mend the damage to ligaments and tendons but they think it be just scare tissue and wont be able to. If that is the case then she has to have bones in the wrist fused together and a pin put in losing a lot of mobility and at least 4months off work.

So Ingafgrinn, tell me this. What would you do? Say never mind, i dont need to work. I dont need money. And the fact that my wrist is fucked for the rest of life i dont mind? I think not, you be the first person to try get compansated for it. If you never been in a situation that could affect you for the rest your life through no fault of your own then you cant say civil action is bollox.

I been involved in 2 civil cases myself

1) 7 Years old, pushed of bouncy castle indoors. Smash teeth out due to very little matting. Require lots of dental treatment due to injuries not seen before (london hospital specialists even put it in a journal), that still continues even to this day 18 years later. Lots of costs to cover, lots of pain etc. Why should i suffer due to imcompetance from the company and be out of pocket?

2) Car accident as passenger, serious back injury amoung other things. Lots of drugs needed, basically immobile for few months. Missed lots of University and exams as wasnt able to do the work, thousands of pounds wasted due to that. Insurance is paid for a reason and so got a right to put the claim in against the people that cause an accident.

Just got back from the docs, for those who thought I'd bust up my leg, its not that bad. My left big-tow is all swollen up (can't really put any shoes on now) there's a really deep purple bruise all over

Outside my house, and i mean RIGHT outside, those red/white barriers had all fallen down, due to cars passing to the car-park behind my house they way this gas company have possitioned the barriers and signs is appauliing

Anyway with it being so dark last night, and foggy I didn't notice one of the barriers which had fallen was poking out and tripped over it crashing down onto the pavement.

Doctor says it will take a few weeks for the swelling to go down, keep the foot elevated and take loads of pain killers, once the bruising hits the nail its gona hurt like mad (ohh and advices not to walk or drive - which work aint to happy about)

Im on annual leave next week - and just talked to my manager here, looks like they will let me work from home wed/thu/fri this week, so its not too bad.
