It doesn't, but as usual it fits with the proceeding section:

"Jurors had been told Sinclair attempted to cut off his wife's head, cutting through her carotid artery and her spinal cord."

Apparantly he went mental and therefore shouldnt get the full term, just manslaughter.

aparantly he was a bit quirky. when she admitted having an affair he flipped out and did her in. it seems that if he's left it at that the court may have been more lenient, but he tried to take her apart too o0

He admitted killing her in the kitchen of their luxury £1m rented home but said he had been attacked and stabbed by his wife and thought he was dying.

So, she lost it and attacked her mental husband, who lost it in return and tried to cut her head off?

Sounds like manslaughter to me. If not simply a case of whacking him in a loony bin.

I know if my bird stabbed me, I'd probably stab her back ;)

murder is pre meditated ..

man slaughter is spur of the moment

sounded like a non planned thing to me

so manslaughter was right

No, murder is murder, premeditated or not.

Manslaughter is accidental killing.

There's a very big difference.

wiki manslaughter said:
Voluntary manslaughter occurs when the defendant kills with malice aforethought (intention to kill or cause serious harm), but there are mitigating circumstances which reduce culpability. Voluntary manslaughter is a lesser included offence of murder. The traditional mitigating factor was provocation, however others have been added in various jurisdictions.

Getting stabbed is quite provoking ;)

And accidental killing is accidental. Like when you run someone over.

Morally, yes. By the letter of the law, no.

I don't really know. If I found a catholic priest paedo, with previous, abusing a vulnerable choirboy, stopped him, sent the kid home and then slyly put a bullet between said paedo's eyes, would that be morally wrong, or just preventing further indescretion?

/leaves for pub :)

Go to confession with him first and ask him to absolve you for what you are about to do first. Then at least your soul will be fine ;p

1st the anti-terror laws thread and now this, you don't seem to have a very good grasp of basic laws. Are you anti-police by any chance?

What I meant was that there is a big difference between manslaughter (ie dropping bricks from a bridge into a river for a laugh, and one brick lands on the head of someone on a boat), and murder, where you have your hands around somebody's throat but "I didn't mean them to die".

Murder=The unlawful killing of a human being, under the Queen's Peace, with "malice aforethought".
Actus Reus (guilty act) being the first bit unlawful killing of a human being, under the Queen's peace
Mens Rea (mental act)-malice aforethought=BUT dont actually need malice or aforethought.........just need to have intent to cause death or GBH through your action

Dropping bricks isn't manslaughter I wouldn't think. I think your view of what constitutes manslaughter is a bit skewed m8.

Manslaughter is getting into a fight in a pub and accidentally killing someone rather than just hurting them.

Dropping bricks with unfortunate timing is accidental. You'd probably get done for some offence (acting like a tosser, maybe), but not manslaughter...

when i read the article, this was in the very last paragraph while the sub headline was near the top. did they edit it?

actually i think this is a myth, or an americanism of some thought.

murder is the unlawful killing of another human under the queens peace, with intent [to kill], the result of which is a dead body.

you dont need to have thought it out beforehand which pre meditated would suggest.

bloudy uara beat me to it.

i believe most here are probably wrong about what murder or manslaughter is. if it is proved that you didnt intend it, then it isnt murder. its not as simple as saying well i got in a fight in a pub and he just sort of died.

and id also like to know why everyone blames the judge for the conviction? its the JURY who decides what the person is guilty of. the judge gives the sentance that the members of the public find the person guilty of. in that case, 9 years is rather long for un intentional killing.

I think you're all assuming that this murder/manslaughter thing is black and white, but what the accused does after the victims death is also taken into account. Hiding the evidence or even not reporting it to anyone is like sitting in court with a big sign round your neck saying murderer as far as the jury are concerned.

I didn't find anything wrong with what I read in the report.

I thought it might of been something like the Arnie letter where the beginning of each line would spell out 'arsenuggets' or something. I had to read very slowly to find something alarming to me.

Meh, must just be me but we all know how he feels (for those who have been heart broken) and he's mental and she stabbed him, that would pretty much be enough for me to lose my mind tbh.
