Help --- My Bad, Bad Aria Experience

On 26 April, I orderer, online, a MP3 player from Arianet (www.aria.co.uk). I've been having problem with the company ever since.

When the player was delivered to me, I found that the FM radio was not functioning. I had a couple of friends to verify the problem, then I reported the problem on their web site and sent the player back on 1 May. On 4 May, I received an email form them informing me that they had received the return and it "will be processed shortly".

I phoned them after 2 days, having heard nothing from them. They told me over the phone that it would take 7-10 days for them to do their test on the return. I was puzzled for it should not take more than a couple of minutes to verify the fault. Anyway, 7-10 days became 7-10 working days. I contacted them again on 25 May, this time they claimed that their "Terms and Conditions" entitled them to test returns within a 28-day period and I just had to wait. I read their "Terms and Conditions" on http://www.aria.co.uk/Terms.asp and could not find any clause mentioning 28 days.

What shall I do next?

This seems to be the relevant clause - It depends on the definition of commencement of contract though - Is it when they receive the returned goods (probably) or after testing is complete (less likely).


To return a working replacement of equal or better specification to the customer within 30 days from the commencement of the contract. If, after 30 days, a replacement can not be sent for whatever reason, a full refund will be given if requested at the current market value of the item. If this is not ascertainable, then a refund will be given for the value of the nearest equivalent item.

As for what to do next - Allow them the 7-10 days then start creating hassle, asking to speak to supervisors, then managers if you get no joy, to get an answer about whether they've tested it and whether a replacement has been dispatched yet or not.

email them, telling them that there terms don't metion this... and save a copy, just in case

Thanks for the advice.

I remember reading somewhere that a purchase contract commences when money changes hands unless otherwise stated explicitely. Based on this, they have already violated their own "Terms and Conditions".

Today, a month after I sent the player back, I got a message from them informing me that they've done the test and found the player to be faulty. Congratulation to them for spending such a long time doing a few minutes work especially since I sent it back only a few days after I received it. Originally I asked for a replacement. Now I am having second thought in case the replacement is also faulty and I have to wait for .....
