Haven't played the game in a month or so and just got the last patch today, was actually so bored I read the EULA and came across this,

7. Selling of Items You may not sell or auction any Game characters, items, coin or copyrighted material. The selling of items, coins or any copyrighted part of the Game's player character
whether through online auctions, newsgroup or postings on message board is in violation
of this EULA. In addition to violating our agreement, selling items and/or coin violates
our legal rights and may cause damage to the Publisher and to the goodwill in the Dark Age
of Camelot name.

Has this always been part of the EULA or is it new, I myself am totally bored of the game and was going to sell my character off, not for any vast sums of cash, just enough to cover a new game or two, so what now? Can I give my character away?

The official policy is in the in the FAQ.

I think I remember Sanya saying it was not really their intention to pursue players who sold their character when they moved on (what would they do? ban?) but the clause was there to stop farmers etc.

They did succesfully prosecute a US company recently who's business was selling characters and items for RPGs. That decision caused quite a stir as it was the first time a 'click accept' EULA had ever been ratified in court.

Whether they pursue individual players or not, I should imagine that any purchaser is going to be a little wary.

Not quite. Black Snow sued Mythic, not the other way around. Black Snow was a company that powerlevelled characters to farm items and gold to then sell on their web site for cash, and on ebay. Mythic had ebay shut down the auctions run by Black Snow, and Black Snow sued them over it. The judge ordered the case into arbitration, but by then it was moot anyways because Black Snow's lawyers petitioned the judge to let them withdraw from the case... because Black Snow did not pay their legal bills, or return their phone calls. Serves them right for taking a bunch of sleazy con men as clients but whatever.

Anyways, there was no court ruling, so there's no jurisprudence. It's hardly a landmark case.

When Black Snow announced their lawsuit, Mythic wrote their point of view here: http://www.camelotherald.com/more/270.php

Thanks Arindel,
I was misremembering this article which did not specify the defendant/plaintiff. Will teach me to double check the facts before posting :).

What may be of more interest to Dandyx is Mark Jacobs saying:

"Additionally, it is my hope that when these issues are resolved, we will be able to endorse and welcome the sale of accounts."

On the herald.
