I agree with his actions and the grand jury's decision, I'm not a parent but I don't think anybody (parent or not) would act any differently if they came across that scene.
Given that the father even tried to subsequently save the scumbag's life (recorded by the police despatcher); which, frankly, is more than I would have done, I think "justice" has been more than served. I'd have set the cunt on fire.
This is why juries and judges are required. It would be a cruel set of people to not give a father some leeway in that kind of situation. Summary execution is rarely defensible but when it's as extreme as this...
