What about somebody been tried on an offence that somebody was found guilty, but then later released due to compelling evidence that suggests the OTHER person done it?

This shit is happening IRL.

If the rule saying you can not be tried twice has been scrapped id imagine the person who was originally cleared would be tried again.

The Court of Appeal can now quash an acquittal and order a retrial when "new and compelling" evidence is produced.
