Dealing with Landlord/lady-problem for me help!

Ok so ive been living in this apartment in madrid for 3-4 months now. I live with the land lady and 1 other person, who left at xmas. I thouh all was cool with landlady in regards to have friends/g friends round, as i brough people in past and she not there to care.

But yesterday i had a friend round (a girl) and we were in the sittingroom watch dvd's and was about 4am, and she was crashing on the couch and i was on the other sofa and we semi sleeping/watching. Anyway landlazy goes apeshit and is like complaning about lack of respect for the flat and for people there, apprently she was studying while we were listeing to tv and she culd hear us. But why she did not ask to put volume down, i have no idea.

Anyway the upshot of this is is that i want to move apartments, and will do so asap, as its basically impossible to bring a girl back and sleep with her without the cathloc landlady being a pain in da arse.

So i ask this- What is the least painless way to leave the apartment and still make sure i get my deposit back, ive not much experience in these kinda things. please hlep!

ive not got a written contract with her atall, and nothin like that was agreed on, i feel if we have a disagreement over summin that was never disgussed it wuld work in favour of me getting my deposit back.

If there was no written contract and she wants to be a bitch about it, she could just keep your money, say you never gave it to her and there is nothing you could do in a court of law

Alternatively, if there was no contract of how long notice you need to give, you could just walk out if she did that. She could also kick you out too...

Advice for the future would be to ALWAYS get a contract. Even if it's your best friend you're moving in with, get a contract otherwise there is always the oppurtunity for you to get screwed over.

For now though, you're just gonna have to be extra nice and hope... If she does take the money off of you, call her a disgrace to her religion. It would afterall be stealing.

The most common residential lease these days are known as AST's (or assured shorthold tenancies). Under an AST, both landlord and tenant have protected rights. The most important being that the landlord can't just throw you out onto the street, even if you piss up his window singing I'm Merlin the Happy Pig. He needs a court order. This will cost him and takes time.

if you have a written tenancy agreement:

give the landlord 30 days in writing (all your legally obliged to do).

If you have no written agreement:

arrange for new digs, if your deposit = a months rent dont pay the lastmonths rent. bounce a cheque whatever.

speaking from experience here it's always best to resolve things as amicably (sp?) as possible because when you need to go back to get a reference then you wont have pooped in your own hat so to speak.

Even if the person your dealing with is a total nightmare if you can just find the strength to bite your tounge and reslove things untill you get a written document of reference from them you'll benifit greatly from it in the end.

As i said this is personal experience here i hope it helps someone eventually
