I bought a pair of trousers from a company called "suits you" for £25 at the beginning of this month. I wore them once and the hem fell down on one leg, so i thought "mmm faulty, take 'em back, get a refund". I put them through the wash for returning and the other hem came done.

Clearly, the goods are faulty after one wear.

I took them in today for a refund, expecting no problems at all (they are less than 28 days old). The manager refused refund because they had been worn, but offered to repair them. I wasn't happy, but i said "ok". My gf works in a shop and stated that it's your statutory right as a customer to demand full refund for faulty goods, regardless of washing/wearing. She says goods that have clearly been worn months down the line can still be returned if they are faulty, or stitching comes away. She came back with me to the shop to explain this to the manager (who wasn't there) but a peon assistant said "it's our policy to send them away to our customer service department to be assessed before refund".

An argument ensued about "customer rights" and "policy" etc, the peon advised to come back 45 mins later to speak to the manager (who was on lunch). In that time, i came home and swatted up on the sale of goods act to see where i stand. As I suspected, if the goods are not fit for purpose or faulty, I am entitled to a full refund. However, it did state that if an exceptionally long period of time passed (i.e months/year) then they may only partially refund.

I went back to the manager, read him the riot act about "trousers not being fit for purpose bought" and "clearly faulty", but still no refund - he was adamant that they had to go to their customer service desk for assessment before a refund.

So what the fuck do i do if they still refuse refund? Less than a month since i bought them, both hems come down, washed once and I can't get a refund?

They did offer exchange/repair - but I stood my ground on a refund.

Sounds like a 'manager' who hasnt the authority to do anything more than put a paperclip on the latest stack of memos from head office.

Your right, but can you really be arsed fighting about it?

I've called them, but noone there at this time. I cannot believe they're refusing a refund for faulty goods, it's like the Overclockers of the suit world.

If they don't refund you for faulty goods, they're breaking the law.

Personally I'd suggest sitting on the sales counter until they gave you the money. Let them call the police if they like, its not like they want the hassle.

Invoke the name of trading standards when you talk to the company or if your sick of them actually phone trading standards - they enforce the consumer protection act in the UK. The consumer protection act is actually the product of an EU directive so they do have their uses :)

This company are clearly in breach - I always get a full refund for faulty merchandise regardless of the notices that say things like 'no refunds' in stores - no-one wants trading standards prosecuting them!

Actually companies are well within their rights to test products for faults. And I think legally the time to test can be how ever long it takes to send to the supplier, have them test it and return it.

aye, it's not fair to the company to have to blindly give out refunds without some form of authenticating the fault itself.

In terms of electrical goods, then yes I agree they need to check it to confirm it's faulty.

But if you take back clothes with an obvious failure in the stitching, then it breaks one of the key points of the sale of goods act that goods must be "satisfactory quality" and "fit for the purpose bought".

Both the hems fell down, they're faulty and not fit for purpose; therefore i'm entitled to a full refund.

I appreciate they want to send them to their customer service department to be looked at, but by law they'll have to give me a refund for the reason above.

The OFT doesn't pursue individual claims BTW, if they refuse to refund then you'll have to take them to court (of the small claims variety). The OFT will only pursue companies that make a habit of breaking the law with regard to consumer rights. you should definitely contact them anyway, as if people don't it they won't know to investigate.

i had a similar beef with ann summers after a dodgy purchase last year. i bought a corcett top which cost £45 only to discover that the two halfs of the corcett were completely different sizes and when put on one side of the top sat 2" higher than the other, and also the stitching at one side had already begun to come away.

i went back down to the shop the next day and explained my problem. i was met with less than helpful staff who told me that they did NOT give refunds under any circumstance.
I showed them the poor measurement of the garment and the hog of a sales woman retorted with "thats the way its ment to be, its not a top designed for flat chested girls like yourself, a corcett it designed with bustier women in mind and if you had a more average size bust it would sit perfectly". well needless to say that was more insults than my temper could handle! I was flabbergasted. I went off on one totally. THE TOP WAS A SIZE 6! I asked the woman to name me one person who was a size 6 AND had a bust the size of what she was describing. She couldnt. I then told her i would be making a formal complaint about her attitude.
I then pointed out the poor stitching to which she offered me a credit note or exchange. I declined saying that after the way i had been spoken to and after purchasing shoddy goods there is no way I would want to buy anything from their store ever again.
They told me to take it or leave it.

So i left it and brough the crap corcett back home, I got in-touch with citizen's advice, an old college friend who became a dressmaker, trading standards and ann summers head office.
head office said they would investigate the way the staff had spoken to me and offered me a £10 gift voucher as compensation (pathetic), citizens advice & trading standards told me i was within my rights for a full refund and that if I had no luck with the staff to seek legal guidance.

so back down to the shop i went with my dressmaker friend who explained how there is no way in hell bust or no bust that the corcett would have fitted anyone, and also i enlisted the help of a policeman pal who was happy to come down to the shop in full uniform and witness the incident (ensuring no more insults were thrown in the direction of my perfectly satisfatory and in proportion bust!).

i left the shop with a full refund and a sly smile.

oh tankgirl, how I hoped it wasnt some bit of random clothing but a Rampant Rabbit XL GTR eXTREME Edition. That would have made it much more fun :D

i dread to think what the staff would say if u complained about a rabbit.
even though i know from experiance they dont work as they claim to and are poorly designed anyway.. but thats besides the point! hehe
