righto lads and lasses, a little something here for discussion:

a man was charged by the police recently here in holland because a mobile network relay point (one of those antenna thingys on top of tall buildings and suchlike) had logged his phone as being in a certain place at a certain time. he was promptly brought before a magistrate, who was wise enough to drop the case on the grounds that a)charging someone based purely on technical evidence can't happen here and b)the relay had a range of ~8km or so thus the man could have been in x number of small towns around the antenna.

what do you think?

well, one assumes the men in blue had "reasonable" cause. not even the dutch police can pick up people with no reason whatsoever...that spain...teh guardia heh ;)

This only proves the _phone_ was at that location, not the person using it, the user would have to confess or admit they had made the call first.

The "mobile phone" defense was used succesfully as part of the Damilola Taylor trial, some of the defendents claimed they made a phone call and it was surmised it was at a distance away from the crime scene that could not have been reached in the time given had they committed the crime - link

I can't see how mobile phone evidence can be used at all, as it is so flaky because anyone can use the phone and the "cell" radius varies a lot, afaik they can't use CCTV or recorded medium in UK courts as evidence either, although it is reasonable grounds for suspicion and arrest.

Yeah that damilola thing was bollox... just because someone made a call from that phone from a place that was too far away from the scene of the crime to be able to make it there to be guilty, doesn't mean the actual owner of the phone did it... or did they have voice recordings of the conversation ??
