Theft requires intent of deprivation. You clearly didn't have that intent. I don't see how you can be convicted. Just stay calm, and don't be an idiot.

As Tilda said, be totally honest, compliant, and cooperative with the police. If you are totally innocent you have nothing to hide. They have more important stuff to deal with than some kid who's nicked a mobile. Don't piss them off giving them a hard time. And get a lawyer. You don't know it all. :)

Got a solicitor before i even went to the station :p

my father was making a fuss because they wouldnt let him sit in on the interview so he said that he'll call his solicitor. while he was the police started asking me whethar i thought i needed one, easiest reply ever "well yeh because i dont know the law and my rights as well as a solicitor

fucking hell! All this over a stolen phone? Jesus, where do you live? Kensington or something? Only reason police round here will bother getting out of bed is for drug arrests, rape or assualt/murder.

Also, I cant understand why you are on bail to appear in court. The cps dont normally go to court unless they are 90%+ sure they can get a conviction so unless you admitted to the police you stole it, i cant really see why they are going to court, without doing some investigation. On what basis are they going to get a conviction on you? Hearsay? They have no evidence.

I'm guessing he is bailed pending further investigation, in other words they have jack shit on you and are hoping either you crack and confess or some witness comes forward, basically if what you say is correct you will be released without charge when you appear at the station.

A few pointers here.

Firstly you are not on bail to court, it is what is called 34(5) bail which basically means you will have to return to the police station on a fixed date to either be questioned further, be charged for an offence or released without charge.

The police are duty bound to investigate all reports of theft. There is a government initiative at the moment where moblile phone theft is classed as high priority. This is due to the number of robberies involving kids and phones.

Other than speaking to a solicitor, do nothing that will put you in danger of further action. Do not have any contact with the complainant.

You can take action against him but this must be done through the civil court. It will go nowhere though. The guy is quite entitled to make a complaint and the police will make sure, as far as possible that his story is genuine.

Even if you are charged with an offence don't panick. The file still has to go to the CPS for a final decision. You maybe offered a caution. This means you have to accept you are guilty but will avoid the nesecity to attend court.

Do not involve yourself with speaking to your mates who are witnesses. This will all be done in good time by whoever you choose to represent you, should this be nessecary.

Quick questions as there are a lot of law type people here...

What are my rights in required to being verbal threatened in college by another pupil, whilst going to the heads is all well and good; I doubt it will actually end up in any kind of punishment..

The exact words being (roughly - some scouse / townie language that i have translated for you):

"If i ever see you outside im going to knock you out.."

Can I do anything in regards to going to the police etc.. You know something to make them worry and so on..

Theres acctually a lot of cases where the cps will press on with a prosecution where there is almost no chance of them securing a conviction in the hope that the defendant will shit himself and confess.

Personally if I were charged and knew I'd done nothing wrong I wouldnt accept a caution, you have to have faith in the system that if you've done nothing wrong, then you'll be fine.

In sweden a prosecutor cannot take a case to court unless he is reasonably sure of a conviction. If he keeps taking cases to court that have a low chanse of ending up in a conviction, or havent done the necessary work to get a conviction, he will first be the subject of diciplinary actions and then lose his job if he keeps it up, which means a prosecutor makes damn sure to make a thorough preparatory work, and gives a higher level of security for the citizens.

im not on bail to attend court but they said im on bail to return to the police station in march, and my bail thingy says ive been arrested under suspicion.


im not accepting any caution or anything im not getting a record for this lieing fucker, and if i did id be pissed off enough to find and smack 10 shades of shit out of him, then probably get arrested for something i had actually done.

kinda hard to not talk to my friends since i dont know who the police will talk to and all my friends were there that night :p meh

can't the police interview people who know your type of character, such as employeers/teachers? Surely they will confirm that you are of good intent and would not steal something such as an ipod...?

In short: pigs are scum. They are always confrontational, more so than alot of chavs... they seem to provoke rather than help alot of the time. Though I did see this amazingly hot copper walking down the road yesterday, black hair ... she was gorgeous :eek:

of course there are the occasional bad apples. i know a couple of bent coppers. Its like saying "all solicitors are scum" because there are a couple of bent ones.

Yeah, i'd have to agree some poliemen are just assholes, i mean giving someone an £80 on the spot fine for pulling onto the hard shoulder and asking the policeman for directions :eek7: yeah that's something to be proud of :worthy: Also, the police try an' verbally bully confessions out of you, such as when your in the back of the police car where there are no tape recordings :touch:

using things on you, to wear you down and admit to something you know isnt right the police know isnt right but all they want is for you to say it.

Yeah it was decided by the House of Lords on the 8th December 2005, that evidence gained through torture is void. But pushing someone to say something they neither want or mean to say is what the police *sometimes* do.
