its out of warranty so hitachi wont fix it unless im willing to pay for it.

It will be the supplier that you can make a claim against, not Hitachi. Warranties make this kind of thing simple, but their responsibility does not end when the warranty does, it is just more difficult to get them to cough up.
Consumer law says that they have to supply something fit for use and that it should last for a reasonable while. For TV's they reckon 7 years, may be less for plasma but I'd doubt it is much.
You might need an independent engineer to write a report saying that it failed because of a fault, and then take the suppliers, not the manufacturers to small claims court, assuming you win, and you should, you'll get the cost of the tech report back as costs.
