Another work question...

I handed my notice in last Tuesday, first verbally with my General Manager and later that day in writing. I have to give a month's notice (which I did), but I verbally agreed with the GM that I would "be released in the middle of next week". I put in the letter that I would finish on the 28th and gave it in with no questions asked.

I heard last night that they're going to make me work the full month, essentially disregarding the agreed verbal and the written leave date. Can they do this? It's been 4 days since I handed the letter in and nothing has been said about it. Now, they haven't asked/told me about it yet but I hear that they are going to and I'm not sure where I stand.

Also, do I have any god-given rights to expenses that I have accrued whilst in their employ? I found some travel receipts from last year (training courses and stuff) amounting to about £200 - it's no major fuss if I'm not entitled to them but obviously I'd like the ££ if I can get it. They have a sort of unwritten rule that expenses have to be claimed back within the month that they were incurred. I guess it would be a nice gesture if they paid them but they don't have to, right?

i believe if you accepted the original term of 1 month in the contract then you must give 1 month. if you leave before i suppose they could sue you for breach of warranty. though people do walk out of jobs all the time and ive not heard of people being sued for it.

imo ofc.

Yeah if I just stopped turning up then I'd understand if they were pissed - it's just it was an agreed date and I have a feeling they are going to try and extend it to the one month in the contract. I just plain don't want to be here anymore but I don't want to jeopardise the last paycheque and/or any holiday or days in lieu that I'm owed.

afaik its against the law to withold holiday payments and such, something about unauthorised deductions from wages in the employment act. dont know enough about that bit of legislation to say anymore though.

Just take all your holiday. And for good measure, claim those expenses.

If the expenses are pre-April they can tell you to FO. As for notice, yes they can hold you to it, but, their only real power over you is your reference. I once had to work out three months' notice right to the very last minute of the last hour; it doesn't usually happen because employers don't generally like people on notice hanging around being "a bad influence", but if you're doing something critical and they can't get anyone in in time, then its their prerogative (as it was in my case).

I would claim any expenses you have incurred. And if you have any holidays left take them. You are allowed to take holiday in your months notice period.

If they say no then they have to pay you for them.

You could just leave. The worst that would likely happen is you won't get a reference for your next job...

Claim them, leave when you agreed, don't worry about it.

I think generally speaking people are too nice to the business/corporations they work for. You owe them nothing really, if they thought it would make them more money they would fire you in a heart beat and they would never pay you a penny more than they had to.

If I don't do the job properly for however long I'm here do they have any disciplinary power over me? I've stated time and time again that I don't want to be here but they just seem to be ignoring me.

Can they withhold notice period money if I say "I'll work up until <insert date> and not a day after", even if <insert date> is before the end of the notice period? I don't give a flying rat's ass about the reference I would get, I just want the cash - and to get the hell away.

I so don't want to be here anymore, I'm supposed to be flying to Thailand next week ffs but it now looks like that's gonna be put on hold for a month. :eek:

Why am I so goddamn placid about things like this?!

Why not get some actuall legal advice?

If I had a flight to thailand I know I wouldn't stick around an extra week at work.

Verbal agreements don't really count for shit if there's a written contract that says otherwise, if you leave early then they can't withhold pay for the work you've done but you can say goodbye to any expenses claims.
