against CoC or not?

What really matters if its a CoC breach or not is:

is the encounter still ongoing, as someone still having aggro from zahur or one of the adds?

If not it dont matter if zahur is at 5% hp or 100% hp. aslong as the mob is not aggro vs one in your grp its up for grabs.

Then there might ofcourse have been some sort of show of respect from the farmer in question, letting you keep trying it and pass on to the next encounter. But thats very rare.

I'm sorry but I don't agree. Whether the mob is on 1% or 100%, if the group that are trying to do the encounter still have 1 alive and the encounter is not reset, then the group still haven't finished their attempt on the encounter.
If the group was totally WIPED, fair enough, but we had 1 rezzer alive.
It's a simple case of stealing and hopefully GOA will sort it out.

And it should cover the whole encounter, lets say a zerg is killing all cyclopses round Cyrek while somebody is kiting him when a random chanter runs by and ml9 focuses it with a couple of bots (just an example, doesnt matter if this happens like this but draws a fine picture)
