ok, so i bought a soundcard (audigy) and it hasnt worked since day 1. ive had it for 2 weeks trying to make my computer work with it, even tryed putting it in someone elses computer but it didnt work. so what i wanna know is do i still have the right to take it back? this is all i know -

the product must do as specified
it should of satisfactory quality
you have so long to try the product (30 days?)
you have the same rights even if you lose the receipt (which i have done)

can anyone tell me if im right or wrong? all i wanna do is change it for the next one down (5.1 platinum) and spend the change on new RAM or something (if he doesnt give me money, only store credit) oh, and it wasnt private sale, i got it in a shop.

edit: also, can you get compensation if the product causes damage i.e. emotional damage caused by stress cos the damn computer wont fucking work?

Worth going in and asking, I'd say. I've never had trouble replacing duff kit, but places usually only get arsey if you demand a cash refund. If you're simply after a replacement I'm sure you'll be fine.

ok thanks summo. like i say, all i want is the next card down and will buy something there and then with the 20 quid change.

I bought a cabinet from Ikea, it said "self assembly", but I put it on the kitchen floor and it didn't fucking do anything for 2 hours, had to make it myself.

No receipt? Well then unless you paid by credit card its not going to be easy to prove where you purchased it.

from what i seen, he has copies of the receipts with his signature on. they are all hand written, on that carbon paper stuff, what ever it is. i would think all i need to do is tell him the date, what i bought and he should find it in his book.

Should be okay... seems like a lot of places will take back the product anyway. Stock inventory and bar codes come into play, or something...

For example...

A while ago I pre-ordered GTA3 from play.com, but when the release day came I couldn't wait anymore and bought a full-price copy from my friendly local GAME.

A few days later my play.com copy arrived. Thinking that if I returned an un-opened copy I'd stand more chance of a refund I took it into GAME.

They were confused. The bar-code didn't show up on their list thing. What's more, the girl behind the counter noticed that the rating logo on my copy was different from the ones on their shelves. "Must be a different batch" I explained. She remained non-plussed but exchanged it anyway. I took my cash and ran down the street, greatful to be out of there without the latest Sims expansion pack.

So the moral is... in there, somewhere.

Jeez, dont shout.

The moral is, to definatley, always, always keep your receipts. (or get your Mrs to do it ;) )

Well Willier, next time i get a hold of one of those Mrs, she'll be keepin a tight grip on everything (oo err) i took it back this morning, he said we cant actually refund because the card works, its just not compatible with your comp so hes trying to get me a soundblaster 5.1 for this afternoon and aslong as i spend the £20 quid change there he couldnt give a rats arse cos he can just put my card back in circulation and he isnt losing any money.

You use a Creative card, you get fuck all support, the card does incredibly retarded things, and yet you go and buy another one? Am I missing something here?

really i have no chouice, he only sells creative cards and seen as i cant haver cash refund i have no choice but to buy another one.

afaik although you have the same rights, if you don't have proof of purchase, the shop is well within its rights to tell you to bog off.

I have a creative audigy sound card in my pc , its always been a bit clonky, never worked properly with voice on Half-Life mods, in fact when Ive tested it sometimes my pc has claimed that my" pc cannot make sounds " or some such malarky.
Anyway, I recently downloaded some new drivers, for win 2000/XP only mind, and since then it has been fine.

Since XP I've never bothered with getting drivers for my SBLive! Value on the other PC, I've just made do with the native XP drivers, which work fine.

i finally took it in (cos he stocked back up this afternoon) and he gimme an audigy 5.1 live! and with the £21 change i bought a huge frickin heat sink thats for 2ghz CPUs, for my 1.1 ghz cpu, its about 10-20 centigrade cooler now, and it has a flashing neon light on it :cool:
