Anyone stupid enough to go online with the hacked firmware in place deserves to get banned to be honest, I will probably be trying the hack myself in the next couple of weeks as an experiment but there is no way I will risk going online and getting my Live account banned.

id only consider it if xbmc does get ported over to x360, but according to the xbmc forums they are waiting on a chip first

Yep, until either the encryption is cracked on the .xex files or someone figures out a way to implement a mod chip there will be no XBMC sadly. People are working on looking for holes that a mod can exploit in but I can't see it happening for at least another year. The console itself is very difficult to hack, Microsoft just made a boo-boo by leaving the DVD firmware open to exploitation.
