Last I heard it was classed as an assualt on somebody, but like most things in the law you could probably take it to court and then try to convince them that not doing so would have endangered lives. But that law has been around for a long time.

To be fair though I think the woman is a bit dumb to think she should be allowed to pass despite drenching someone. If she got herself into a situation where not going through the puddle would have been dangerous, then she wasn't driving with due care and attention required for a driving test.

To be honest I would have thought of slowing down first rather than swerving into the other lane to avoid a puddle..

I'm with Tom on this. I know people who've failed their test for driving through puddles and splashing pedestrians. Tough shit on the fat bitch :)

You should have slowed down so that you didn't splash the pedestrian. Only splashing them "a bit" is not an excuse because you would have only needed to slow down slightly in order to avoid not splashing them at all.

Why do people seem to have such problems accepting they have failed a driving test? I had a friend who failed his driving test after hitting a parked car. He also thought he had been unjustly failed because he "only just brushed it" and the other car really shouldn't have been parked there.

Driving is about awareness and consideration, this driver displayed a lack of either.

Although I do sometimes purposefully attempt it when going past the bus stop near here in an attempt to douse the moronic chavs using it to swing around on.

Its not hard to step a little bit back, only coming forward when the bus comes etc.

Thats not the point. Just because somebody else does something wrong or makes a mistake doesn't make it ok for you to drive into them (or in this case drive in such a way that splashes them with water) Being able to say "technically that wasn't my fault/responsibility" does not make you a safe driver and when something does go wrong the results will often be much worse than somebody who thinks about other road users.

3rd attempt at the test, frankly it should be 3 strikes and you have to wait 5 years. There's too many people on the roads who have taken it over and over until they pass, like my uncle who's an awful driver and probably passed by terrorising his examiner on the 14th attempt.

I agree with that actually, some people are just not mentally capable of driving.

The whole test system needs revamping tbh, to many old rules that don't apply to modern day vehicles. They should also introduce the same system for new drivers that applies to new motorcyclists. By that I mean the limited engine size. That way you wouldn't get some rich 17 year old fresh from passing his test driving a 3 litre monster that they're just not ready for.
