An old but true story thats still good to hear round the internet fire-side:


A Charlotte, NC, man, having purchased a case of very rare, very expensive cigars, insured them against fire among other things. Within a month, having smoked his entire stockpile of cigars and without having made even his first premium payment on the policy, the man filed a claim against the insurance company. In his claim, the man stated the cigars were lost "in a series of small fires." The insurance company refused to pay, citing the obvious reason that the man had consumed the cigars in the normal fashion. The man sued…and won.

In delivering the ruling, the judge, agreeing that the claim was frivolous, stated nevertheless that the man held a policy from the company in which it had warranted that the cigars were insurable and also guaranteed that it would insure against fire, without defining what it considered to be "unacceptable fire," and was obligated to pay the claim. Rather than endure a lengthy and costly appeal process, the insurance company accepted the ruling and paid the man $15,000 for the rare cigars he lost in "the fires." After the man cashed the check, however, the company had him arrested on 24 counts of arson. With his own insurance claim testimony from the previous case being used against him, the man was convicted of intentionally burning his insured property and sentenced to 24 months in jail and a $24,000 fine.

This story always reminds me of how fucked up that particular part of US justice is ...

A guy chockes in a restaurant. The manager of the place performs a heimlich (sp?) saving the guys life.

The guy sews the restaurant ... not because he chocked on their food (can't sue for that) ... but because the manager broke a couple of his ribs saving his live...

That's fucked up if you ask me :(

There was one brilliant one back when i was doing basic law modules in uni best part of 8 years ago that i read.

A bicycle manufacturer (can't remember which was so long ago) was sued for $350,000 (bear in mind how long ago it was) because an adult bought one of their bikes and fell off it, getting some nasty grazes and a broken wrist.

Apparently the bicycle manufacturer was at fault for not putting any signs on the bike saying that you could fall off it...

Good thing in the UK the law protects first aiders, someone tried to sue a first aider who saved their life and they sued for reviving without permission. Judge told him he was a wicked human being and to get out his court.

As far as i know no trial has been successful against a first aider

Americans have also successfully sued a microwave manufacturer and a tumble dryer manufacturer for not stating you can't dry pets in both appliances.

The funny thing is in America, if you save someones life they can sue you, if you don't save their life you can be sued for negligence.

Well the "do not dry stuff in the microwave oven" might not be obvious to at every single human being, so i can follow the reasoning of the lawsuit if the manufacturer didnt mention it in the manual (wich you probably are supposed to read :p). Altho there must be some kind of ' minimum common sence' factor that people should have if they wouldnt want to get sued for being such idiots that its not safe for them to walk the streets... I mean, if a man cant figure out its not safe to fall off a riding bike he probably should be put in an institution for being so stupid that he might hurt other people by not knowing that its probably not smart to kick someone in the nuts ^_^
