recent court cases with amazon selling ipods (think it was ipods - was some electronic thingie) for bugger all cash came to the conclusion that it was only a binding transaction once they'd taken money from your account.

Amazon only take the cash when they deliver - not sure about GAME.

There's probably clauses somewhre about being able to refund the price of something if it's out of stock.

game take it out when they deliver, thats correct. but if a price says 99p then it must be sold at that price? in a shop if a bottle of coke says 80p but it scans at £1.10, the shop must sell it at 80p.

The problem is, you can't order it cause it's out of stock. Instead of that, they give you an option to notice you when the game is back in stock. I've filled my e-mail there, lets wait and see if they're gonna contact me that ToA is back in stock for 98 pence :D

//me thinks that the price should be something more like 20.98 pence but they forgot to put a 2 in front of it :/

Lol, that happened to me and 2 mates. We played about 4 days and had to quit because the combat lag was insane.

Not a mistake.

They do a lot of stuff like this in the big sales - this "Price Slash" sale has a lot of knockdowns.

I was able to pick up a load of Xbox games from my store for £0.99 each recently. ;)

The £0.98 pence means it's in the price slash sale ;) Everything knocked down ends with .98 :)

Now this explains why I couldn't get an answer from distrubution about getting a copy of ToA sent to my store :(

Yes but theres also a clause in the trading standards laws that states a trader has the right to refuse a sale without any explenation, so they can just turn round and refuse to sell it to the person if it's a mistaken price. Not many traders do that though because it kinda alienates the customer and they dont want to lose custom.

Incorrect. If a shop has the price labled at 80p and it turns out they made a mistake, they can refuse to sell you the item unless you pay full price.

This is true, however if the shop does not correct the price label, then they are breaking the law.

I've just experienced this first hand...

I recently ordered an Abit Radeon 9800XT 256mb from dabs, which they listed for £133 (must have thought it was the regular pro with 128mb). It should be £276. After I ordered it, they removed it from the site (must have realised their mistake).

They invoiced me and charged my card. The invoice reads '9800xt 256mb' and charged my card £133, but they sent me a 9600xt (which isn't even £133).

I returned the card using their own courier system over a week ago, but have not even had a refund. They still haven't given me a refund, but I'm not sure whether I should push them for the card, as they've already billed and invoiced me for a 9800xt.

well everytime the label has been wrong, the shops always give me the difference back. thats why i assumed there be must be some law. maybe they just dont want a customer spreading the fact they wouldnt refund a 20p difference in the price ;)

Tbh I think the only route forward for this type of game is that adopted by PlayNC for Lineage and City of Heroes. They allow you to purchase a CD key online and once done, allow you to download the complete game. Sure you dont get the physical media, or nice manuals etc, but it's certainly a lot easier. It cuts down on the manufacturing and distribution costs, and the slice of the cash taken by retailers. Also it opens it up to a global market then, since there's no problems obtaining the software anywhere in the world.

Though I suspect this last point that holds them back in a franchised operation like DAOC, as opposed to a single provider like almost all other mmorpgs. If it was available online, everyone would get the american version and GOA would be screwed.

High street stores are really geared to consoles. Big releases with a short lifespan and high turnover, not the mmprpg type titles at all.

So you cant actually buy something thats 'out of stock' you can only be notified when the product is back 'in stock' if the price is the same when they have some more, theyre going to be bloody busy!

wouldnt it b false advertising saying its 98p then saying, oh, and u need 2 add another £14.02 (so its £15 dummies ;))?

and also if they gay about just ring up short changed (uk people might know it, its a program where kids complain there getting ripped off) get the to whoop games ass, coz they end up giving like £1,000 in free stuff coz they wanna look good. :D

Well true but *if* the store can prove that the item is mistakenly priced eg. the majority of the products on display are correctly priced they can refuse to sell the item. Also if the store is able to prove dilligence in price checking they can also refuse to honour a mistaken price. However it's difficult to provide staff rotas etc. to demonstrate due care and attention so it's a difficult area.

If in doubt try Trading Standards (in the UK) but bear in mind that TS do NOT champion the consumer vs. the company they only back what the law states is correct. Alot of people think Trading Standards are on their side they ain't! Most companies policies are checked by Trading Standards and if the Customer Services manager states he/she is actually acting within company policy and you read the company policy (most large compnies will have a printed version available) and they are the chances are they also acting within the law. That said in exceptional cases TS will take action.

Caveat Emptor in all honesty :D

An advertised price is only an invitation to purchase, the contract is only made when money changes hands.

Any vendor can refuse to sell an item for any reason or indeed for no reason whatsoever.

However a Vendor can fall foul of Trading Standards by advertising a false or misleading price, since this tends to be enforced after a number of complaints have been received it rarely comes into effect, and most high street stores will sell to you at the lower price just to avoid the complaint being made.
This is entirely at their discretion and they are not required to do so.

Last PC industry complaint I heard of being investigated was a printing error in a magazine, for which the company profusely apologised to all and sundry but was not required to sell at the incorrect price and no action was taken against them.

According to an old bye law which has never been rescinded, a Cavalier King Charles Spaniel has right of access to any public building in the country with or without his owner, this includes premises held by Public companies though it has not been tested in court in a case where Health and Hygiene regulations specifically deny access to animals.

Just so ya know.
