Do I even need to mention that Blizzard have no *legal* rights in closing accounts people have paid for?!

Then again, those selling the gold etc. on eBay probably haven't informed their local tax authorities about it either, so not really that *eager* to claim their rights ;)

Thats why we press that little " Agree " button on the CoC screen when we first installed the game and when theres a patch.

If we are breaking Blizzards code of conduct then they have every right to shut down the accounts.

people have paid for the install disks and they are renting accounts, thats about it :p

When playing on Argent Dawn in Mulgore on Saturday evening there were four or five individuals with sexually explicit and racially abusive names using general chat. They were spamming swear words, "STFU's" and lots of unpleasant sexual comments.

I hardly ever report things to GM's of games but it was so bad (possibly the worst I've come across in about ten years of playing online games) that I reported them, listing the names and quoting things they had been saying in chat.

Here's the reply I just received:

Seems to me that we have a whole different quality of staff to those enjoyed by US WoW customers. I will be resubmitting my complaint, but I'm not holding my breath for a result.

Just because you think this is so and keep saying this is so, doesn't make it so.

The likelihood of you being proved correct is in the event of someone sueing Blizzard for closing their account for the above reasons and that person winning. Then we'll see who has the legal right.

Should Blizzard lose such a legal challenge, I have a hat ready to saute and consume.

Reasoned argument was tried in the other thread on this subject OT, it didn't do jack to change Meduza's "opinion" of what blizzard is legally allowed to do.

But thanks for posting that info though, its the first time I bothered to read it in full. :)

Nope, but they don't have to either.

If you want really good caricature, find the NPC named "Linken". (assuming you've played the Legend of Zelda games, in particular the first part of the series)

Actually they do own anything inside the game. So linken, Hin Denburg, robot in badlands saying he will be a real boy someday, etc....anything ingame is theirs. According to the EULA/TOA/stuff.

So if you kill someone ingame, they b*tch about it, you can always say:

"Hey, it's not you i'm killing, it's blizzard" :p

If the npc names have a legal disbute, they will have to deal with it. It doesn't change the fact that they still own everything, even your character name. Just saying. I'll probably give my soul to blizzard too when i get my computart.

Parody doesn't break copyright.


As for legal rights - it's a private server. You have no legal right to access it, so Blizzard can suspend access at any time.

I don't wish to cause a flame fest but alot of people don't realise how many rights consumers have and that alot of things you agree to in the "terms of use" when you log in wouldn't stand up in court.

I won't go much further as I know that in the uk these kind of laws are being reviewed as online games that you pay subscriptions for haven't really been avaliable for the mass market before. I also know nothing about laws in the other european countries although I suspect EU countries would be similar.

There are plenty of examples of why the "terrms of use" isn't really legally binding but probably the most obvious is if you consider the point where you have to agree to it. You don't agree to the terms before you buy the game but before you play it. That means you could buy the game install it on your computer input the CD key but then not agree to the "terms of use". However if you then tried to take the game back to get a refund you would have problems. You will notice that microsoft gets around this problem by putting sticky labels on the CD cases which clearly say what you are agreeing to when you break the seal and thus avoid such problems (microsoft don't have problems with subscriptions though...).

You "electronically" sign a contract when you press I Agree button, so I suggest it is legally binding. I don't work in contract law, but suggest that this would be legally binding as far as a court is concerned. Another game I play has started taking cheaters to court :) and getting them banned from the internet completely. If you think you can take on Blizzards legal eagles - be my guest :) - personally I encourage a robust banning policy.

Who cares wether or not these bannings can be upheld in a court of law? People are paying to play a game by a set of "rules" that we all agree to. If someone breaks the rules, they get a ban, a bit like being sent off in a game of footy. You don't want a red card, don't break the rules.

I agree with Meduza from a "EULA's don't mean sh*t" perspective, but if farmers / ebayers / cheats are getting bans than I say good job to Blizzard. Makes Myhtic / GOA look even more pathetically inadequate.
