Legal Matters

Ok.. I have my daoc accounts on auto renew (although I want to stop playing).

Have two accounts and its £16 a month all together. They recently shut down the support service and subscription pages, saying:

The Subscription pages and Rightnow will be down until further notice starting this evening. We are sorry for all the inconveniences this may cause but the maintenance we have to perform is a lengthy one.
Of course we will keep you informed as soon as new information arrives.

Now, as im on auto renew they took the cash and I was unable to cancel the accounts due to the subscription pages being down. Am I legaly intitled to my money back or not? :(

I know its only £16 but still :p

The so called email support is really a service they call 'Rightnow'.

You can sign in and post a question from the webpage or send an email, but the reply is always from rightnow even when you send email so I guess they both same. They provide no phone support

I'm guessing you can't claim as sites and companies like those have small print that says they won't be liable in the case of software failure...

First question, have you logged onto DAoC and played it since they took the money out?

There probably is, but theres always loophole in the law people can abuse, i think theres a law to go against there so called Software Liability thinge, since they are taking cash away from his account when he has tried to stop it, so its an effective theft i think.

Just ring your credit card provider and give them the details, they'll send you a form and claim the money back. Piece of piss, though it might take a while.

If you explain what you have here, I can't see them having a problem refunding you. As soon as it's back on, just ask them about it.*

* I'd imagine this approach is subject to the 'stress' rating of the support staff.

You could just ring the card company and ask to cancel the debit.

Even if you can't claim the money back, just say that the stress of them drawing out money that you couldn't reall afford to pay out has put you under extreme stress. As a result you couldn't go to work and it also made your hair start to fall out which has dented your confidence for life.
And maybe it made you go £16 overdrawn and thus you got fined by your back for anything up to about £70 and would need to claim that back also.

Possible few thousand pound lawsuit if you wanna go for it :p

heh

We've had equally silly cases here in the UK.

I remember one were a woman sued a washing machine manufacturer, because she had put her cat in the washing machine in order to clean it. The cat obviously died. She argued that there were no warning labels on the washing machine or in the handbook stating that you couldnt put cats in.

She won.

Now everythings plastered with warning labels in order to prevent similar action.

just explain to them you want your money back after rightnow comes back online

otherwise go to your bank and explain things

(GOA dont have your signature, so you will 100% sure get your money back)

sucks for GOA, but such is life

You put coffee on your dashboard and drive off. You deserve to die whilst in some embarrassing position for being so stupid, not just get burned.

Isn't their a 'cooling off period' of 7 or 14 days on the contract? Anyway, their website will not be the only way of contacting them, pick up the bit on top of one of these:

Then, press the buttons according the the number on the website, and 'speak' to the person on the other end, using your 'voice'.

McDonalds - to their credit - provide ingredients and nutrient info as a leaflet you can pick up and have done for a while. So no, he can't claim on that. Unless he can claim that they didn't make it obvious enough that this leaflet exists.
