leaving a job with untaken holidays

ive finally managed to haul ass out of mc donalds into a night club. apparently i need to work this weekend as scheduled and after that im free to go.

i believe i have about 60 quid in holidays still to be taken. when i leave are they obliged to pay them regardless of me actually having a holiday or not?

Depends on the company and their rules.

I'm in the same boat, I have 2 days annual leave to take before April 1st (when I relocate to our Leicester office) check with your line manager, they should be able to tell you if you loose the days or you get paid for un-taken days

Usually you get paid for holidays.

If they say no then take the days holiday during your notice period....

You should get paid for them, or as dys said take them as part of your leave. They can't take them away from you.

Well if you get to the end of your notice period and have days left they can refuse to pay them stating "you should have taken them".

If however they deny you taking holiday with "we are too busy" then you can demand they pay for them.

Leave entitlement

as a side..

I have an issue where i have 9 days leave, to be taken before the end of March, i already have 10 days leave booked in March so i can't take anymore.

I've booked 3 days off in April and my manager has taken the 3 days from the 9 still owed to me for this year.

dunno if he can do that tbh :s

so from that website, i can assume they have no choice to pay me even if i dont book holidays.

Ive just taken my annual leave before i lose them - I have a month off work now!

They made me sign this form to say that i cant take off this much time at once again next year, but im hoping im not gonna be here that long :p

Thats just poor planning then.

I would ensure I have my leave/pay arranged a month or so before I leave that way they can't shaft you on your last day...

well if acas say you can have it, then im sure you can have it.

anything else is good to go for a tribunal :)

and what if you cant 'plan' a month or so before you leave due to work commitments/schedules....

that is why i had 19 days leave left and only 2 months to take them.. sheesh :twak:

2 months is plenty time to take 19 days or get work to pay you out for them.
If you lose out both ways then your negotiation skills need improving....

I didn't say i was losing out, also my work is scheduled 2-3 months in advance plus the fact? (not sure) that it is legal to pay you for holidays not taken when not leaving employment.

Also don't presume that my negotiation skills need improving, do you know me and who I work for?.. no i didn't think so

So can a company just refuse to pay untaken holidays? I'm trying to help out an ex-employee but apparently the company I work for just flat out doesn't pay them for any holidays they had untaken at the end of their employment.

We paid accrued holidays when someone leaves, even if they are leaving because they have been dismissed. So I am assuming that legally this has to be done.

You gave the impression you were losing out 19 days holiday.

Correct, at least as far as salaried staff goes (UK). Slightly different ball game for hourly paid.

If you have annual leave entitlement of 25 days and leave 6 months into the year your employer has no obligation to pay you/give you the full 25. If you have taken over 12.5 days you may well find you are docked the remainder from your final pay packet.

Additionally, if you are on a bonus scheme and leave before the bonus period is up you are entitled to nothing whatsoever.
