I know you don't live in the UK, but 99% of roadworks, maintenance etc etc is subcontracted out from local government to private companies, therefore it would be the private company that would be sued, not the council. If you tripped over a broken paving slab that was there due to the negligence of the council (rather than the company contracted to ensure there are no health and safety liabilities on public rights of way for example) then you would sue the council.

Companys who put the prices up to the councils if their costs go up, putting up our taxes.

where exactly are you getting info for the solictors fees of 50-100k and where exactly is the info to show the council tax will go up because one person takes civil action against the council?

Not saying people shouldn't sue, ever, just that there is a cost to us all from it, so it makes more sense in the exceptional circumstances.

I guess being brought up away from the city, where trees aren't made safe, roads don't ever get repaired, and there are no streetlights, I got used to watching where I put my feet, and didn't need to blame anyone else if I did something silly.

I'm not saying it will go up, the numbers of roads repaired or other services may go down. You're surely not claiming money will just appear from nowhere ?

Most such claims will probably actually get sorted out by insurance policies, for which the premiums will go up if more people sue, affecting everyone who gets one (any company, basically). I know various sports and activities are getting harder and harder to economically insure, due to fear about being sued.

Individual cases tend not to be a big issue, it's what happens when you scale individual cases up to the size of a country. The 'nanny state' that so many deplore is caused by this.

That depends, a heavy footed mate broke his foot dancing on a flat floor - injury doesn't prove the case. (He was ratarsed)

Alan's case may well have been exceptional, though.

The claim money won't come from the council it will come from thier insurance policy so that point is muted.

im not picking on you directly, but it amazes me how people seem to think money comes from thin air.

where do this insurance company get there money? that's right! from the clients, the policy holders pay premiums...and what happens when to many claims are made and it starts to cost more money to pay out than they get in premiums? that's right! they put the premiums up!...now...who pays these premiums?

does nobody understand the fact that as sueing people sweeps the country, it has an effect on the economy, and a knock down affect to the quality of service we can expect from retailers/councils/services ETC ETC.? the more money being spent on paying out claims, the less money there is to actually do there jobs, no matter what company you are talking about.


Having said that, if you have been subject to some nasty accident caused directly by another party, and its costing you money(and no i dont mean sitting at home on the couch for a couple of weeks while being paid sick/holiday pay)/lifestyle, then go right ahead and sue the bastards. but otherwise, just watch where the fuck you are going, and try not to use "the wrong type of ladder".

did i mention that this world sickens me sometimes?

Insureance is one of the biggest scams going. The amount of times they refuse to pay out claims because of minor discrpancies (after you have shelled out hundreds of pounds to be covered). If it costs you money (taxi to work etc) due to some one elses negligence why should you not be able to claim the expenses back ?

Plus you can be sure there will be more effort made to stop it happening again if a claim is made.

Is it worth it ? I think its the gas company who dug up the road and didnt make it safe enough.

My mum got a coupld of grand a cple years ago from local council due to a post being in a silly place where there was very little lighting and she tripped over it and had a big cut in her leg.

what she done was..

took load of pics of the injury whilst its fresh (add some make up to make it look worse!!!)

contact one of those free accident claims companys on tv

sit back n wait for the cheque :)
more to it than that ofc.. but the solicitor does everything 4 u

I on whole agree with Darzil.

It is however important to differentiate between someone whos making a claim because they can get some cash and they fancy some cash, and someone whos making a claim for legitimate medical expenses suffered due to someone elses negligence. The latter type are credible claims and should be dealt with sympathy, and the former dismissed.

Also, get a proper solicitor, not the unlicensed , unregulated cowboys on TV.

yeah you have to see both sides. My brother litteral taped a car in front about 2 years back, Both stoped at a light, light went green, the car in front set off then stoped my brother hit his bumper at around 5/10 mph. Both pulled over looked over the damage, ( a scratch on the bumper on my brothers car thats it ) swaped numbers ect. Anyhow 2 months later he gets a snotty letter from one of those TV claims guys, stating that the other guy had to spend 3 weeks off work with whiplash, and had to reapir his car at a cost of £600 so there were taking him to court blah de fking blah....
Anyhow my brother knew what had happened but had sence to actualy ask the bus driver behind him for a contact number, as an independant witness. Saved his bacon there as it was him vs the other guy. Anyhow they got nothing and the other guy had to pay costs. My brother could of suied back, for loss of earnings, stress ect but he could not be arsed with it.

back on track.... i hate those who try abuse the system, its there help after all. It's because of people like that git above, that the councils have removed all the conker trees from the back of my house, as they dont want kids falling onto the big spiky railings! And why they took down the swings and monkey bars climbing frame jobby and put some big crappy plasic thingy in that you couldnt fall off if you tryed. Kids these days cant be kids because of crap like that.... i once fell 4 floors because i climbed the drain pipe up to my mates bedroom window, and it didnt hold me. My own stupid fault... i never did it again. These days there would be a 10k lawsuit beucase the pipes fittings wasnt good enough..... stupid :m00:

If the claim is genuine, as in you didnt fall down the hole because you were half pissed or just wasnt plain watching where you were going, then go for it.
