Anyway do you get in trouble if you send an email asking if its ok to send them marketing information in the future????

I think you can - well, soon. There is legislation coming into force that requires individuals to "opt in" to mailing lists and marketing information, so sending an initial "would you like to subscribe" email is illegal spam.

I would think that your best starting point would be here

www.dataprotection.gov.uk/

or speak to your company's Data Protection officer, or at least the person in the company who filed your company's interests as a holder of data.

As a general rule of thumb, EU Directives have to be implemented into UK law at some point. More often than not, the substance of the Directive will be given affect in an Act of Parliament. The Act merely confirms what the Directive states (in Parliament's own words) and includes or omits information as appropriate to the UK specifically. In short, what is in the Directive is roughly what will be in the Act. Even after the Act has been passed, the Directive is still of legal use if you ever need it in court.

As for mailing the companies on the list your company has acquired, I'm fairly sure (Shovel) is correct. Whilst I doubt anybody would take action against your company, it's not a good idea to provoke people, especially when it is likely to be against some law concerning unsolicited communication. If in doubt, just ask your legal department :)

Kind Regards
