If I were a level 50 sorcerer but only had say 35 in the mind spec line would it be to hard for me to charm equal level creatures, if so is there any point to specing in it as than my damage ability would be way to limited.

34spec charm = lvl50 creatures when you're lvl50 yourself.
But, erm.... why were you making a sorc again? We need good CC, not gimped nukers.
Whole of hibernia runs around with even more body resist than heat, don't even bother. I know 41body sorcs who rarely top 200 on their DDs anymore, against hibs at least.
