Got a phone today but i have a better deal and am wondering if i can return the phone as it is a contract phone...

Trying to read the back of the contract paper but the writing is so small i can't see anything!

If i can take it back do i have to have a specific reason or can i just say i am unhappy with what i've got?

Very much depends on the nature of the agreement. Is the phone you want to return an upgrade or a new contract phone?

When i was in O2 it was a bit of a grey area in a sense as to if you could return the handset or not.

IF the contract you took out was a brand new contract, then you should be able to go back into the store of purchase and just return it. Just make sure to take all the paperwork etc.

IF the contract was infact an upgrade - There is a *small* chance that they may refuse to cancel the contract within the 14 days IF you took out the upgrade via the store.

And finally, IF you took out the contract over the phone, either as a new contract or as per an upgrade, you CAN cancel your contract within 14 days due to the distance selling act.

I only mention these because O2 changed their rules about 8-10months ago and quite a few people weren't happy

Shop just been in contact and i can return it they didn't seem too happy thou.

They're probably on a commission. Make sure you get some sort of confirmation that it's been cancelled.

phone was the N82 btw nice phone i just didn't do the research into what other contracts are about.

I believe every phone comes with a 14 day cooling off period so you should be fine to send it back "I can't get on with the phone" should be a good enough reason. You will get a bill for the days you have had it and any calls made,

Took it back but worried now as i gave him everything he checked the phone took the back cover off entered which i believe is that EMI number or whatever it is on the phone into the computer i think gave me my contract/receipt which i got this morning told me it has been cancelled but i got nothing to say it has except his word.

Ringing up my cousin later as he works for that company and gonna ask him should i have got anythin.

Expect to get phone bills in the coming months. Carphone Warehouse are notorious for that sort of thing. I would go back in and demand proof of cancellation because you could very well end up in the small claims court with those wankers.

If you took out a Direct Debit, ensure that it's cancelled.

If you signed the contract in the shop, you may be in trouble.

If you signed it at home, you have a cooling off period.

tbh though situations like this are why we have contracts to begin with.
