I know there are a few car experts on these forums so maybe someone can help me with my problem.

My brother has gone to work in South Africa for somewhere between 6 and 18 months. He has given me his car while he is away. I have insured it and am using it as my main car. I got the insurance documentation today and it said at the top that I was the owner and registered keeper. I phoned up my insurance company to tell them I wasn't and they said I had to get this changed. I asked why this wasn't the case for my wife, or for when I was a teenager and my parents owned the car and I was told that these were allowed exceptions but driving your brother's car is not. I am the only person insured on the car currently.

I have all the documentation for the car but I would need my brothers signature to change the ownership and this is going to be difficult. He is not in reliable email/phone contact yet. Is there anything I can do to get this changed without involving my brother? Am I going to get into all sorts of trouble if I don't get this changed and there was to be an accident?

Thank you

Sounds like you need to get your brother to sign the V05 for to say he is no longer the owner of the car and sign it over to you.

I dont know about getting in trouble for it, but if you do have an accident your insurance is invalid.... so yes i guess you would be in trouble.

You should have sorted this prior to him leaving, it's not worth the risk. Get the ownership transfered over; the DVLA may be able to arrange something with him to get verbal confirmation, or he could send them a letter advising of the transfer of ownership to you.

Ownership is not the same as keepership. If I was in your position, I'd just fill the V5 in, fake your brother's signature, and send it off. That'll sort out the registered keeper, as for ownership, well your brother has given the car to you. You don't need documentation for that.

This is the answer. I sign like 10 registration documents a week, and I could sign then Mickey Mouse for all the difference it would make.

In fact, sometimes I do :)

I was going to mention that we have similar handwriting in my original post...

I did check, my insurance is valid as long as its in the process of being changed. People buy cars all the time and start driving them before the DVLA has processed the form.

Also I must say thank you to whoever pointed out that we should have done it before hand. Clearly moving to another country on the other side of the world and getting Visa's sorted etc is not nearly as important as reading the fine print on the DVLA's website.

can't you just verbally ask or get your brother to email or send a letter to you as proof that he has said you are allowed to forge his signiture?

I am sure there are some indurance companies that allow you to insure a car you are not the registered keeper of. Premium is higher though as its.considered.more.risk as you might be.a.Twat with urn. Some insurance co's don't allow it at all though.

... but yes, just forge the signature, not like they have anything to compare it too.

This is the DVLA we're talking about. They're incompetent fools, nobody will ever know.
